If you want this kid to be punished for what he did, you are going to have to do some legwork yourself. I know it sounds really crappy, but far to often, prosecutors and police want to write off a situation like that. Not write it off as some sort of youthful indisgretion, but as something that an immature child who hasn't been raised right would do. I don't know about Florida, but here in California, you have every right to sue the kids parents for damages. If it were me, I would go a step further and ensure that the child was prosecuted because of the malicious intent. If nothing else, at least if he does it again, there will be a pattern established and more than likely tried as an adult. I would go to the police tomorrow and request a temporary restraining order and then to the school district to talk to the principal. This sort of behavior should result in expulsion.

And you can expect his "punishment" to be as lame as your response..... which feeds right into this very behavior.

Sorry to take shots at you but this very attitude of your is part of the problem, I would have consulted an Attorney already if this was an unprovoked attack from behind.

It was unprovoked/ from behind attack and the atty was called minutes after.. the police are doing a report and criminal charges are being filed... the shots do affect me... I know it will all be addressed if I handle it calmly and through the right channels

Let me give you a little free advice..... When dealing with the public school (in fact most schools) YOU HAVE TO PUSH TO GET RESULTS.

I would have certainly spoke to the police and see if charges couldn't be brought. ( I forget the age involved)

Don't question "why" this kid did it, I did stuff when I was a kid that had no logic to and all of it wasn't harmless either, in fact I went to a school where this same type thing when on and I can tell you, this kid was getting "high fives" about it from his friends, now it's important that his friends see he pays a price, lay back and let "justice" take it's course and I doubt that will happen which feeds into the "Limit factor" these kids learn to live with in school and life.

Those aren't easy cases to prove, but if you can actually get to trial on one, they will frequently try to settle out of court. The perception that it would create if they were found guilty is far more reaching than a kid getting sucker punched to them.

Very good. Many times school administrators, independently of public or private, will try to sugarcoat things so a scandal is avoided when dealing with cases like these. I hope you guys get your day in court. It is clear the punk will probably get what's coming to him later on down the line anyway...

Yep. If you can prove negligence... you will certainly be entitled to more in damages if the school is named in any future suit.

I have no problem with someone beating on a school bus.....

Lady, people aren't chocolates. Do you know what they are mostly? Bastards. ####### coated bastards with ####### filling. But I don't find them half as annoying as I find naive bobble-headed optimists who walk around vomiting sunshine.

I missed this thread back in Sept. I used to live in Belleville, IL., so I guess I can provide a somewhat unique perspective on the matter, especially since I've worked with Belleville P.D. on numerous occasions as well. My insight - this is no different than what happens every day in a suburban school system somewhere in the U.S. Why was it a big deal? Same reason it's always a big deal. Race.... and the fact that it was on TV. Had one of those elements not manifested itself, we would've never heard about it. Not surprising we haven't heard anything more about it since.

I don't want to allege that your son did anything, Scott, but really, what did he do? I find it hard to believe he was randomly picked by this kid in his class. Did he have a history with this kid? Has this kid attempted to bully him before? Had they recently had a spat over something? The whole "no reason at all" thing doesn't fly. Once again, not saying your kid did anything, but I was 12 once (as I'm sure most of us were) and 12-year-olds have a very developed sense of pecking order. What caused the flaw in the Matrix?
