My fiance entered US as K1 on Nov 12 , 2008. We got married on Dec 12, 2008. Then she filed AOS. She got her green card on July 17, 2009. My question is what date is used to count her residency to fulfill the 3 yrs requirement for naturalization? As I understood from reading the forum; she can apply in 2 yrs and 9 mths. So what date can she start applying?

She would be able to apply for Citizenship 3 years -90 days from July 17 2009. She would be able to file the N-400 at any time on or after Wednesday, April 18, 2012.

The date she got her actual plastic green card in the mail doesn't matter, but the date she got LPR status does.

The "resident since" date that's printed on her green card is the date from which to start counting 3 years less 90 days (almost, but not exactly, 2 years 9 months). So take that "resident since" date, add three years, subtract 90 days. If the "resident since" date is July 17, 2009, then adding three years would be July 17, 2012, and subtracting 90 days would be April 18, 2012.

19 Apr, 2004: I-129F Sent to MSC

29 Apr, 2004: I-129F NOA 1

13 Aug, 2004: I-130 Approved by CSC

28 Dec, 2004: I-130 Case Complete at NVC

18 Jan, 2005: Got the visa approved in Caracas

22 Jan, 2005: Flew home together! CCS->MIA->SFO

25 May, 2005: I-129F finally approved! We won't pursue it.

8 June, 2006: Our baby girl is born!

24 Oct, 2006: Window for filing I-751 opens

25 Oct, 2006: I-751 mailed to CSC

18 Nov, 2006: I-751 NOA1 received from CSC

30 Nov, 2006: I-751 Biometrics taken

05 Apr, 2007: I-751 approved, card production ordered

23 Jan, 2008: N-400 sent to CSC via certified mail

19 Feb, 2008: N-400 Biometrics taken

27 Mar, 2008: Naturalization interview notice received (NOA2 for N-400)

30 May, 2008: Naturalization interview, passed the test!

17 June, 2008: Naturalization oath notice mailed

15 July, 2008: Naturalization oath ceremony!

16 July, 2008: Registered to vote and applied for US passport

26 July, 2008: US Passport arrived.

That's what I was going to say, Rich - that this all ties to the date the LPR status was approved not the date the green card arrived in the mail. :thumbs:

How are you and Lucy doing, by the way? I still remember all of our adventures in the N-400 forum last year. Can't believe that more than a year has passed since our spouses went through the naturalization adventure. :star:

I will also add that it is important to apply to Remove Conditions on the Green card the year before applying for Naturalization - use form I-751. You will note that the green card you have is only valid for 2 years. You need to have filed for the 10 year green card at the appropriate time in order to also apply for citizenship, so don't forget that step :) first.

How are you and Lucy doing, by the way? I still remember all of our adventures in the N-400 forum last year. Can't believe that more than a year has passed since our spouses went through the naturalization adventure. :star:

We're doing very well, and it's nice to be finished with the process. It's taken awhile for it to sink in that we don't need to worry about it anymore. I still stop by VJ most days, but not as obsessively as in the past, and I have a more detached and relaxed attitude about immigration matters. We've only taken one international trip since getting the US passport, but it sure was nice coming home through immigration with the confidence that comes with that blue passport.

We dropped our daughter off for her first day of preschool this morning. She's a bit over three years old, and was born well after we got the green card. Now THAT brings forth a bunch of "can't believe it's been so long" thoughts...
