Need advice

It's probably going to cost you a lot honestly. We are not talking about a simple case here. If you are convicted of a crime you have like an 10% chance of passing your waiver, but there has to be good documentation and you seriously have to have a good reason for the conviction. Hopefully he has that conviction taken care of because if it's not resolved in his own country then you are wasting your money on a lawyer....

What do you mean by taken care of, as in get it scrubbed? He said he could do that if he had to.

What I mean is... if he has a warrent or the case has not gone to court and he has not served his time (for example) or the case is still open because he ran (I don't know what he did so I am thinking of everything here) if he has not been sentenced or convicted and he is wanted by authorities, then you have a major issue on your hands. If he has been sentenced and he has paid his fines and served his time etc... then he may be able to pass a waiver depending on what he actually has a conviction for.

No, he never served his sentence. His cousin brought him to the US instead. He says though that he can take care of it, he has friends. But then he has to go back and I don't want that.

He must serve his sentance even a lawyer cannot help you if he is wanted for the crime. The USCIS will require proof of his police record in order to initiate the process. A lawyer cannot talk his way out of the bounds of the laws of immigration if he is wanted for a conviction. He cannot magically make that go away. the fact that this lawyer is witholding this information from you seems suspecious to me. You are getting the run around from other lawyers because they are legitimate and this lawyer is going to charge you for a ending that will likely fail. $8,000 later I am sure you won't have results unless he goes back to his country and serves his time and/or repairs the conviction. This is my advice. I am not a lawyer, but I know enough to offer you the truth.

What youve written is what Ive thought deep inside all along but didnt want to say it. I don't know if I can deal with a separation.

I think maybe a trip to Philly is in order, see some more lawyers who do this a lot.

Your love is important and special no matter what anyone thinks. If you love him you will stand beside him and not in front of or behind him. He must return to serve his time if he wants to do this legitamately. You know in your heart what must be done, but the separation is something we all go through. I had to leave my husband in his country too until we could get everything right and it was painful, but the moment he stepped onto American soil and he was home and legal... it made our journey worth it. This is why we call it "visa journey" and there are people here that will help you in any way they can. I am testimony to that. I wish you all of the luck in your journey too *hugs*

There is one more thing. If he does get caught here he will be shipped back to his home country fully served with a 10 year ban from the U.S.A. and that separation seems a lot longer than most convictions. Balance that out in your head and heart for a bit. It may help you in this choice (for what it's worth)
