I have a question regarding passports while still in pending AOS process.

My husband is traveling in November back home to see his family. He has his AP authorization, and as of now, no green card yet so I'm asking this based on him not having that yet (although I guess the same question could apply even if he had it).

His passport is due to expire in June 2010, and since he's going home anyway for a visit, we thought he could renew his passport there. However, if they issue him a new one and keep the old one (We're assuming that's what Morocco does), will it matter that his K1 visa and I-94 from his arrival are not in there? I mean, I know they're both invalid and expired at this point, but will that create questions at POE when he shows his AP and then his passport has no stamps or indication of his arrival here?

Or maybe he should just wait and renew his passport here with the Moroccan consulate when he gets back (which I've heard is no picnic either).

2009-07-15 NOA1 for I-485, I-131, I-765 (USCIS rec'd date is 07-12)

2009-08-05 Case transferred to CSC

2009-08-12 no biometrics yet.......called on 30 day mark to report no biometrics, a service inquiry has been made on the case.....

2009-08-25 - received Biometrics appointment letter!

2009-08-27 I-131 (AP) approved

2009-09-15 Biometrics appointment

2009-09-15 EAD Card production ordered!

2009-09-23 EAD Card received

2009-10-06 GC approved/card production ordered

2009-10-13 GC received in the mail!

I doubt it would matter if the stamp is in his pasport, but you might want to contact the passport office in Morocco, or see if they have something on their website about getting back the old passport when he renews. In Canada anyway, you can request your old passport back, although they punch a huge hole in it. lol If they do, I'd get the renewal done in Morocco while he's there!

Something to check into anyway.

What did you end up doing or finding out regarding trying to renew passport while visiting back home?

just curious if may cause any issues going forward when you're missing stamps, original k1 visa, etc from old passport (assuming your country doesn't return) down the road

I haven't found anything out yet.

I'm curious to hear if others have had this experience. Maybe I'm posting in the wrong forum? :unsure:
