THIS POST IS REGARDING MY BROTHER. HE WAS BROUGHT HER WITHOUT INSPECTION AS A CHILD, HE IS NOW MARRIED TO A USC BUT THE PROBLEM IS THAT HIS WIFE IS ON WELFARE AND HE HAS A FELONY. WHAT ARE HIS OPTIONS?

Sorry about that: he was brought here when he was 7 yrs old when my our parents brought him here illegaly under someone Else's passport. He is now 24 yrs old , married to a usc. He has a felony beacuse he gave his step son a spanking and he reoported it to his teacher, he then spent 4 months in prison. He has no papers, no social, nno work permit or green card. i need to know what options he has right now like are there waivers for having felonies? can his wife petition for him? thanx in advance :thumbs:

I would not be surprised to learn that he is under some sort of removal proceedings (is he?)

Unfortunately he has no options because not only did he enter without inspection, but he also "misrepresented" himself by using someone else's passport. And then on top of that the felony....well it does not look good. As your brother's case is complicated, you need to consult a very qualified immigration attorney who may have options for what can be done.

That's just it, I'm afraid that the law does not distinguish between committing misrepresentation as an adult, and having it committed for you by someone else. Misrepresentation is in fact quite serious and can result in a lifetime ban.

Please check out the VJ member "guatetaliana"...I believe her husband was in a similar situation: brought here as a kid on someone else's passport.

That is irrelevant. Once he became an adult, the misrepresentation applies.

consult an attorney, since this case will be complex.

Agree with sister *Len*. Your case is much to complex for this forum. Your brother and his wife should speak to an immigration attorney to figure out what options there are for you
