OK gang. I know I don't post here much anymore, but that's because life has been busy and a bit hard. However, today we received a letter stating our evidence for Anh's ten year GC was insufficient and that is a serious problem.

Hello Matt. I remember you. Sorry that life has been busy and a bit hard. gogal2020 answered your thread in another forum. Oft times paperwork that's filed gets lost. They probably have some if not all of what you sent the first time. I'd take copies again of what you sent originally, perhaps add another affidavit. You can't send what you don't have. Even if you're subletting, can the landlord still make some type of letter up for you saying you're subletting? Do you have any subscriptions to magazines? Letters or cards with addresses on the envelopes addressed to you both? Again, I'd just send a few more things back with copies again of what you sent the first time in the RFE envelope.

No, no magazine subscriptions. Do people still do that? :o If they lost the paperwork, why send this threatening letter? I don't get it.

Maybe they don't like the gaps. We didn't officially rent anything with a lease when we were living in NC for a year. We rented from family. Verbal agreement. We can't prove any of that.

And in our moves we have lost all of our Wachovia paperwork. We switched to Citibank about 18 months ago, so how can we prove our joint account with Wachovia? I sent copies of that paperwork with the I751 earlier this year, but don't have originals or copies on hand. They were lost.

Complicating matters is we moved to Manhattan and have not updated our physical address yet. We need to do that. This is the address we are subletting.

I am really nervous about what our government will do because they just seem to have it out for any Vietnamese who apply, while they give a free ride to uneducated illegals day in and day out.

Wait! You didn't update your address? Does this mean the I-751 was filed with your old address on it?

Lately, ICE has been doing surprise visits on some people who are coming up for removal of conditions. Any chance they went to your old address, and found neither of you there? :blink:

An affidavit from whomever owns the house where you first lived would be acceptable. We had no problem when doing the same.

Also an affidavit from whomever you are subletting from.

This has nothing to do with her being Vietnamese. Sounds like lost paperwork. Resubmit what you sent before along with any and all additional items that show comingled lives. Gym membership, BJ/Costco/Sam's Club cards, all mail addressed to the both of you wherever you have been living together, etc.

Submit a notarized statement from the both of you stating that she does not have a license, does not drive, and therefore is not shown on your insurance.

I use Geico for my car insurance and my wife is listed on there. She does not drive. Under the drivers section it only shows my name. I always thought that could be something I could use, although I went IR-1 so wont need it.

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)
