Sheesh...as if I didn't have enough to think about with trying to get funds together for the AOS, I've started getting ready for filing this year's taxes and finding all kinds of "goodies" that might have to be done since Pat is a non-resident alien....

No, he's not working yet. And I tried doing both the head of household and the married filing jointly and we'd get more back doing it married filing jointly. I read in another thread on here though that because he's a non-resident alien that we can't file a joint return....is that right?

Maria doesn't have to file anything. She has no earned wages.

There is nothing to file for him. He hasn't earned a wage and he will be taxed differently if he had. I am not going to complicate things. I will file head of household and claim Maria, if I can.

Richard may have a little more insight on this topic.

That's what I thought as well....I still need to find out if I can file married filing jointly. Think I'll call the IRS helpline.

It's ok....the IRS helpline...was no help. All they did was keep transfering me to different departments! Never did get an answer!

I called a tax office in Jourdanton and found that one of the tax preparation agents has experience with filing tax returns for immigrants!! She has cleared it all up for me and we have an appointment to go in and see her this weekend to get the basics started. I'll take my last paystub and then we will wait until my actual W2 comes in to file just to be sure that all the numbers match what was on the stub!

What a weight off my mind!

I can claim him....and boy am I ever getting extra $$$$...lol!

No, I haven't sent AOS yet....our 90 days are up this month but I am struggling to come up with the last 400.00 I need for the fees.

I would get the paperwork prepared Liz, make all copies. Then once you get the $455 you can just put it in the envelope and send it.

Maire... You can send it later. As far as I know, the expiration of the stamp isn't that big a deal. But I would still work on getting the paperwork prepared.

You can but you just have to be very careful because technically once the I94 expires and you haven't filed AOS he can be considered "illegal".
