There is a longer waiting period at the service center for approvals of the K3, because it does "push" your 130 to the back of the line and 130's get approved faster.

HOWEVER, the k3 is scheduled faster than the CR1 for interview and there isnt any processing time at NVC either. This is a "plus" of the k3, along with the fact that its the only spousal visa that enables you to obtain a 10GC without lifting conditions 2 years later if you time your AOS right. This makes the K3 a good option for some that maybe want to plan it that way...

There are pro's and cons. Check them out before you take a few posters telling you its obsolete and discounting it. You didnt come on here to ask if you should file the k3 or not, but you will read many ppl saying not to. Study all sides before you decide to file for the k3, thats my advise. :)

Its up to you on what is important and how you want to handle it. Before you send the 129f to make it a k3, I would check the uscis timelines and weight the difference in processing times...CR1 vs K3 at your service center.

Calling someone foolish and being generally condesending isnt what this forum is for, pushbrk. You have a ton of knowledge and are helpful to many, but in this instance.... not so much.

The facts you mention are all correct but I disagree with your evaluation generally. The faster trip through NVC only roughly compensates for the delayed petition approval, making it a wash, at best with regard to timeline. This further confirms the assessment that the K3 saves no time and CAN delay the reunion with a spouse. I do take direct exception to the advice to check the difference in processing times for I-130 and I-129F for spouse at service centers, since the two petitions will be processed together.

While using the K3 to potentially avoid removing conditions is technically possible, it's only going to work for those who do NOT want the foreign spouse to work for more than a year after entry or are willing to trade the EAD fee for the ROC fee. There are trade-offs everywhere but it's a rare instance where K3 has benefit today. The vast majority of OP's on the subject are thinking K3 simply because they are misinformed about it being faster.

What I said was to compare K3 to the CR1 processing times... they are processed together only if you file for a K3. What I meant was to check the processing time and compare filing the CR1 vs the K3 before deciding to file for the K3 or not.

Thats why I said "vs" they are processed together if you file for a k3, if you choose to file for the Cr1 alone, the processing time changes hence my advise to check the timeline difference at USCIS between the two in order to make a decision.

You are probably right about most people simply thinking its faster than the CR1. But I think people should know all of the facts before totally discounting something.

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

That's a good conceptual idea but in my extensive experience here, those who have already assumed filing for the K3 is the way to go, have not bothered to become aware of all the facts, probably won't bother and are better served by hearing the conclusions of others who HAVE evaluated the totality of the information available at the present time. Very rarely, a poster will describe a set of circumstances that are a good fit for the K3. When they do, they get that information too.

Facts are cheap...knowing how to use them is precious...

K3 was not a bad visa in my time when getting him here as soon as possible to avoid a fee of over $1000.00 on the Adjustment of Status, but for most people it does not make sense to do the K3. If you want to be able to come into America and be able to work right away and not have to go through the AOS process and pay for the additional petitions, then the CR1 is the best way to go. So it really depends on circumstances in each case. For me it was a good thing, for you it may not be good.
