Called NVC - What's a K2?

I called NVC today to check on our case. They gave me the new NVC case number and advised the documents had been sent to the Vancouver Consulate on September 8th. That was good news

When I asked about her daughter's K2 and whether that had been sent to Manila (where she lives) she said, "what's a K2 Visa, never heard of that" she then went and checked with her supervisor who also had no clue. She advised I check with USCIS.

So, my question is obvious: Is the packet 3 sent to her daugther from Manila or, really who and how is the K2 handled (NVC or USCIS)? The mother lives and works in Vancouver, BC Canada and the daughter lives in Manila. When will the daughter recieve the information?

Thanks

Hi Road 2 Peace Arch.

On your I-129F petition, was her daughter included on the form? Question 13 on page 2 asks her to List all children of your alien fiancé(e) (if any).

Your fiancee's daughter is considered a derivative of the I-129F petition if the daughter is listed on it. The daughter does not need a separate I-129F petition in order for her to apply for a K2 visa.

USCIS forwards your approved I-129F to NVC, then NVC assigns your fiancee a Case Number before the file is forwarded to the U.S. Embassy that your fiancee listed as the Consulate where she wants to process her application.

Since her daughter is in the Philippines, she would have to set her own interview date as well as comply with the documents checklist that your fiancee will be asked to comply with. The list can be downloaded on the US Embassy Manila Website.

You would have to provide your fiancee's daughter with her own I-134 Affidavit of Support (and supporting documents) plus a copy of the I-129F NOA2 and the letter from the NVC which will have your fiancee's NVC Case number.

Her daughter needs those documents and her own passport in order to do the medical exam.

When your fiancee is asked to complete the DS-156 form, she will be asked to name any children who will accompany her. The DS-156K will also ask your fiancee to name any children who will accompany her or who will follow her.

Your fiancee's daughter must fill out her own set of DS-156, DS-157 and DS-156K forms. She must pay her own visa fee (if she is a minor, she should have a trusted relative arranged all these things for her in coordination with her mom).

I don't think any is sent to the daughter directly even if she is included in the petition...so it is her mom's responsibility to ensure that her daughter is able to apply for the visa.

The answer you got from marriedtomrg is a sound one; usually uscis begin the process for non-immigrant visa, nvc handles immigrant visas.

Yes, the daughter was included on the I129F that was approved. It just seems odd that someone, Vancouver or Manila would not send something to the daughter to complete (as you correctly list below) as part of this process.

a k-2 does not use the DS-156k. marriedtomrg has given you alot of good info. a guardian can accompany a minor to the medical and interview. I doubt that USCIS can give you much info. the Embassy is part of the Dept of State. I would suggest calling the Embassy in Vancover to see how the situation is handled when the K-1 applicant and the K-2 applicant are residing in different countries.

Yes, I will call or send e-mail to Vancouver depending on which they allow for questions. The K2 child is 19 yrs old in this case. Thanks.
