Hey there,

my name is Jana and I have a big problem. :wacko: My fiancé and I we got approved ( K1). It took really long almost 6 month, because there were some problem. Anyway, just in case, I applied to a University, here in Germany. So my plan is now to finish one semester here and than get back to USA, that my fiancé and I can get married.

My fiancé said now, I have to find out, if I can go back to Germany and finish school ( UNiversity), because it would be better and much cheaper.

Now I'm kind of frustrated because I can not find anything over the Internet.

Can somebody help me, if I can get married in USA and than go back to finish just my school. And after school I would go back to USA...

PLEASE HELP ME!!!

You have the K-1 visa now? It is valid for 6 months (so you can wait to come to the US if you like).

If you do enter the US, you will need to file for AOS (to get the PR/Green Card) and will need to wait for this to be approved - or you may also apply for AP (Advance Parole) which would allow you to travel and re-enter the US - there are potential problems with this in relation to what you're asking though.

You cannot leave once you enter on K1 unless you get your Travel Document(I-131). I have read that this normally takes 3 months. If you leave before you get the document, your application is considered abandoned.

Once you apply for AOS, you will get an NOA for all 3 applications, GC, EAD and AP.

You can go to the nearest USCIS office once you get your NOA for AP and try to get an expedited AP, but that does depend on the consular officer.

I am also new to this so I would also wait for other replies from experienced members on this board.

Also, if you have not already considered it, State colleges offer reduced tuition for residents, so once you are here, you will be eligible for it.

(Depends on state to state - some need you to be living in that state for a year to be eligible).

Aug 05, 2009 - Received NOA Dated July 31.

Aug 10, 2009 - Biometrics letter. Appointment date: Sep 2nd.

Aug 13, 2009 - AOS transferred to CSC.

Sep 02, 2009 - Biometrics done at Elizabeth, NJ location.

Sep 16, 2009 - Received emails of EAD(Card production Ordered) and AP(Approval notice sent).

Sep 21, 2009 - Received 2nd email of EAD(Card production Ordered)

Sep 26, 2009 - Received EAD Card

Oct 19, 2009 - AOS transferred back to NJ.

Nov 05, 2009 - RFE for I-693

Dec 02, 2009 - USCIS receives I-693 vaccination supplement.

Jan 06, 2010 - RFE for Entire I-693 needed since CBP/USCIS loses our documents.

Feb 04, 2010 - I-693 received by USCIS.

Feb 17, 2010 - Green Card in mail!!!

Conditions Timeline:

Nov 17, 2011 - Sent I-751 application to Vermont office.

Nov 22, 2011 - I-751 Receipt Notice/Extension letter sent by USCIS.

Jan 04, 2012 - Biometrics done at Elizabeth, NJ location.

Aug 31, 2012 - GC approved.

Sep 11, 2012 - GC mailed. USCIS says we should receive within 7 days

Correct, you can wait up until 6 months to enter the US. After that you have to wait until you have your GREEN CARD. An AP would not do you much good as you would likely have to come back for an AOS interview anyway. After you egt the green card you can return and attend school as long as you are not absent for more than one year (if a student). Our son is a K-2 and attends university in Moscow. He arrived here as a K-2 to follow in July, we did the AOS immediately, he got his gren card (welcome letter) last Saturday and left for his university Tuesday. We will bring him his green card we visit at Christmas. His AOS process was much faster as a K-2 to follow than yours would be.

The other option is to get married (here or there) and file for a CR-1 imigrant visa while you attend school in Germany.

Thanks everybody,

I don't have the visa now. I'm just on package 3.

The reason why I'm asking is, that my fiance is right that school is really expensive in the United States. Well, he just thought that (if it is possible) that I can come over to get married and than go back to Germany, just to finish my school???

But right now it doesn't look like it.

My question was, if there is a possibility to do it or not!!!
