Guy's please a help ....

my I129 was approved in 12 Dec 2006 , the interview was at 10 April 2007 , decision made to return the file back to the approving office for more review since that time i just get some letters telling me various things last one was in 10 Nov 2008 telling that the case is under FBI name check and within 6 months i should receive a notice of action or a decision , nothing untill now !!!

In 1 April 2008 i decided to move I130 which was approved in 12 Dec 2006 , i received a notice of action in 23 july 2008 telling they received my form I824 and that they will prosses it in timeframe they put in the website , 16 March 2009 i received a letter says within 60 days i should receive a noa or a decsion . in 30 may 2009 i received a new letter says case has been delayed under a security check still pending , till now nothing and no answer even with every weel infopass interviews !!! .

what is going on ? which case i shall follow ???

I129 has been pending since 29 month's

I824 has been pending since 13 months .

They returned it over 2 years ago? I suspect this is what the hold up is on your I-130. Have you been in contact with the USCIS on the returned petition? Have they ever sent you out the Notice of Intent to Revoke for that petition? If that first petition hasn't been taken care of, either expired or reaffirmed, it can hold up any other petitions until it has been resolved.

They returned it over 2 years ago? I suspect this is what the hold up is on your I-130. Have you been in contact with the USCIS on the returned petition? Have they ever sent you out the Notice of Intent to Revoke for that petition? Im in contact with them ... nothing new no answers

Last letter i got was telling im under background check was in 10 Nov 2008

i didn't receive any notice of action

Maybe try contacting your congressman with a letter explaining what you went through and what you would like done?

I've never had any experience with this sort of thing so I wouldn't know what to say, but I know contacting your state representative can help.

Even if your I-130 makes it to the consulate and you have a sucessful interview, they will not be able to issue a visa until there has been a decision on the I-129F (K3.) You need to call USCIS and put a service request on your case. You haven't heard anything in 6 months, so they can do this. My case was misplaced after they sent it back and I was having a difficult time trying to get them to trace it. I finally called the DOS in Washington DC. They told me what to do and I did it. They finally traced and found my file. It is now in AR. The consulate and the lady at DOS both told me that the K3 has to be resolved before the visa can be issued. Call and have them put in a service request. Service request have worked better for me than my representatives. I could go on for days with those stories.

I know how you feel and the pain and frustration that you are experiencing. I hope you get answers soon!

About talking to my representive i guess he or she will not add that much , if have a lawyer and he is not able to answer my e-mails because my wife who pays for him not me !!!

About talking to my representive i guess he or she will not add that much , if have a lawyer and he is not able to answer my e-mails because my wife who pays for him not me !!!

Have your wife email your lawyer if he won't talk to you.

Your state representative might be able to help you. I just wasn't lucky with mine. Do call USCIS and ask them to put in a service request on your file.
