Timeline

I have a question regarding my fiance' going to school and the affidavit of support as it pertains to student loans and grants.

We all know that with day to day expenses, making above the poverty level does not say much for actually LIVING let alone furthering education.

So I am wondering if he will be eligible for student loans or grants?? :unsure:

Anyone have experience with this and care to share?

After AOS.

Improved USCIS Form G-325A (Biographic Information)

Form field input font changed to allow entry of dates in the specified format and to provide more space for addresses and employment history. This is the 6/12/09 version of the form; the current version is 8/8/11, but previous versions are accepted per the USCIS forms page.

So does that mean after AOS?

Or after he gets the 10 year green card?

Permanent Resident means after AOS, yes - he will get his PR/Green Card.

Permanent Resident is a permanent resident, no matter if they have a 2-year card or a 10-year card. Both cardholders have the same benefits. :thumbs:

For federal student loans he must be a permanent resident. It is NOT a violation of your terms of the I-864. Other loans and grants have their own rules. Alla received a 50% grant from her university (a private university with private scholarship funds) immediately on arrival and started classes five days after stepping off the plane. She received a Federal grant 3 days after receivng her green card. She is not eligible for STATE grants until she is here 1 year (tomorrow!) and our application for those is ready and will be dropped off at the VSAC office tomorrow.

The short answer to your question is "YES" he is eligible. The long answer is that each type of education, loan, grant, scholarship has its own rules and regulations and it will be a good part time job for you to study all the possibilities.

07/22/08 - Became US Citizen

08/02/08 - I-129F sent

08/13/08 - Case received by VSC

08/16/08 - NOA1

08/18/08 - Touched

12/18/08 - Touched again exactly 4 mos. after 1st touch!

12/18/08 - Noa2 @ 3PM-Gracias Dios Mio!

12/24/08 - NVC sent pckg. 3 to Embassy

01/02/09 - Pckg 3 rcvd. by Embassy

01/09/09 - Pckg 3 from Embassy received by beneficiary

02/09/09 - Medical exam

02/16/09 - Sent back checklist and docs required by embassy.

04/20/09 - We applied for marriage licence. (Township Municipal Bldg Health Dept.)

04/23/09 - Licence on hand

04/29/09 - Applied for Social Security (He was in system!)

04/30/09 - Wedding day!!! Yeeebaa

05/07/09 - SS card in mail. "valid for work only with DHS authorization"

05/13/09 - Sent AOS paperwork.

06/16/09 - Biometrics Apptmt.

06/25/09 - EAD Card in mail!

06/26/09 - Letter saying case transfered to Cali.

08/08/09 - Residence Card in Mail! Yuuupiiiiiii.

THE END FOR 2 MORE YEARS.

As soon as you guys get married he will be on a temporary green card. A green card will make him eligible for loans so he should be able to apply to FAFSA.

Another important factor

On the college application they normally asked the date you have reside in the states. So very important to make a govt ID, even if it's not the driver's license, APPLY for a Non Driver ID, with that ID let say a year later when you want to get resident tuition, you can based it from the date you got your non driver ID.

As soon as you guys get married he will be on a temporary green card. A green card will make him eligible for loans so he should be able to apply to FAFSA.

WHAT?????????????? There is no temporary green card "as soon as they get married" and he cannot receive any loans or grants through FSA until he has his green card. That will be 3-6 months AFTER they file for the AOS, which will occur sometime after they are m,arried. Please read the guides so you are aware of the process. Getting married incurs NO immigration benefit, temporary green card, or anything else, on its own.

Not true. My wife arrived one year ago today. She did not receive a state issued ID until December 2008 (driver's lisence) Our state has a one year residency requirement for eligibility for STATE loans and grants. We dropped off her application for a grant today at VSAC and it was gladly accepted. We used her cancelled K-1 VISA and copy of her I-94 card and DS-156 (which shows her address in Vermont as the address she will live at, and this matches the driver's lisence) to show she has been a resident for one year. No problem whatsoever. Your residency is established when you arrive at the address listed in your visa application, NOT when you get around to having an ID issued by the state.

Also SOME states and other financial institutions will waive the one year residency IF you can show the person did not move to that state for educational benefits. Vermont would NOT waive the requirement. My wife's university waived their one year requirement for grants and gave her a grant immediately on arrival. I know of at least TWOP other couples that received resident status immediately by showing the relocation was not for education benefits and that the USC had resided there for more than one year.
