Getting my drivers License back

My drivers license expired a couple of weeks ago because my I-94 expired while I was in the midst of adjusting my status and applying for an EAD. I called the Drivers License office in Missouri to find out if My EAD (which has just been approved) would suffice as a new visa. They said that I would need a new I-94. Is that true? If it is, how on earth do I get a new I-94? Wouldn't my EAD be considered a valid visa? Please help, this is yet another confusing situation that I'm having difficulty comprehending!

  • You won't get your I-94 extended (so count that out).
  • EAD is not a visa nor proof of legal status and is not enough in many states to obtain/extend a DL (apparently MO is one state that doesn't accept EAD as proof of legal status.)
  • In many states (MO may be one of them) you'll need the PR/Green Card in hand (some, and MO may not be one of them, will accept the NOA1 for the I-485 as proof).

It is inconsistent - each state has its own ID/residency requirements.

That's nothing unusual - sometimes you have to be persistent, even speaking to a supervisor (especially if you know their rules more clearly than they do).. (Be aware though - a lot of these rules are changing and it is possible their web sites have not been updated yet.)

Civil service employees are clueless for the most part, especially if they haven't been there for 10+ years. The newer ones either don't get sufficient training or just don't give a ####### enough to pay attention.

No. You cannot get a new I-94, the person you talked to does not have a clue and like most governemnt employees that do not have a clue...they make up new rules rather than ask a supervisor. Grrrrr. And you want them to run healthcare? Really?

When you get your EAD in hand, go back to the DMV and insist on seeing a supervisor if necessary and renew your lisence.

Your EAD is NOT a visa, you do NOT need a visa to get a DL in any state. You need proof you can remain for a certain period of time. Your K-1 was CANCELLED when you arrived, so you have not had a valid "visa" since day one. The I-94 is not a visa. You have filed for AOS so your status is protected and you will have an EAD in hand soon. Go back when you get it and try to avoid the idiots making new laws on their own.
