Hello!

I got my Conditional Green Card on June 2009, but I just decided to change my name and use my husband's last name as well, I already changed it in my driver's license and on my SSN card, but do i also have to change it in the Residence Card or should I wait until I have to change it in 2011?

I decided to change it without knowing that the fee to have a Replacement Green Card is $370 dollars!!!!!

Will I get in trouble if I just wait until I have to change it to the Permanent 10 yrs Green card?

HELPPP!!!!

My Name used to be: Chavely Rivera

My New Name is: Chavely Rivera-Taveras

Does it make a difference????

I don't believe you are obligated to change the name on the issued PR/Green Card - unless it is of utmost importance (and worth $370) I would wait until you file to lift conditions (I-751).

I would order a new card for $370 if you had changed your name to Tom Mix, switched genders, and grew a long black beard so that you look totally different as well. But to me your new name looks like your old name. Pretty much. What gives?

So unless you use your GC every single day, for whatever reason, I wouldn't waste a single thought on it. I only use my GC whenever I travel out of the country, so basically once every 15 years.

There is no room in this country for hyphenated Americanism. When I refer to hyphenated Americans, I do not refer to naturalized Americans. Some of the very best Americans I have ever known were naturalized Americans, Americans born abroad. But a hyphenated American is not an American at all . . . . The one absolutely certain way of bringing this nation to ruin, of preventing all possibility of its continuing to be a nation at all, would be to permit it to become a tangle of squabbling nationalities, an intricate knot of German-Americans, Irish-Americans, English-Americans, French-Americans, Scandinavian-Americans or Italian-Americans, each preserving its separate nationality, each at heart feeling more sympathy with Europeans of that nationality, than with the other citizens of the American Republic . . . . There is no such thing as a hyphenated American who is a good American. The only man who is a good American is the man who is an American and nothing else.

Chavely I am in the same situation. I got my CG in Nov of 2008 and I decided just now to change my name as we are buying a property.I went to social security and they told me that I need to first change it on my CG...so I will just wait until 2010 when I will remove conditions because with all the expenses we have with buying a house there is no way I will pay $370 for a card that I will use for less than 1 year...

I am surprised they let you change your social security card...as I told you they told me to come back with the new name on GC...

I agree with chox99..

At 2011 when you will be applying ROC you have to give USCIS your 2 years joint tax return with your spouse and also Copy of your Green card and many other evidences shows your/your spouses name..

Since you changed your name on social securiy card ,your 2 years tax returns will be on your new name but GC will show previous last name..Why making things such complicated or coflicted:)) When USCIS see any conflict on anything they will require you to fix problem anyways.

if you decided to change your name do it correct way and change your name in all official documents or if $370 is something you can not pay then you could wait to make these changes at 2011..

Since you already made name change I believe best thing to do after this point is paying $370 dollars and order your new green card with new name on it..Doing it now might not save you any money but sure will save your time and stress that waiting you ahead..otherwise they might ask you to order correct card when you apply for ROC at 2011. You can ignore or delay your things as much as you want but be sure that Government officials doesnt ignore anything when they find out any wrongdoing or conflict.

I am not an immigration attorney nor any kind of expert on immigration laws/rules but just as an another VJ friend of yours I suggest you to do it correct way& on correct time, this way you will save your future time and your peace of mind.

The relevant link to the proper form ( I-90 ) is HERE

Open the instructions for filling out the form at the bottom of the page and note the following 2 paragraphs ..

Section 1, paragraph 1 .. do not use this form if your green card is expiring, use I-751 to remove conditions (paraphrasing) - since your green card isn't expiring then you DO need to use form I-90.

Section 2, paragraph 2 .. use this form to update your card after changing your name or other biographic data (paraphrasing) - that sounds pretty clear ..

If you really want to know if you have to do it, setup an infopass appointment at your local office and ask .. that's free. If it was me, I can read what is written on the I-90 instructions very clearly as stating that I should do it. Spending that $370 may very well save you alot of headaches in the end.
