I-751, Petition to Remove Conditions on Residence

My future ex husband asking me to sign the divorce paper because our married is not work out. He rent the studio living alone holding a lot of depressed because he had the foot surgery last June and couldn't get the job last year. He used to be a teacher but on disability for 2 yrs so far because of his kidney transplant.

Really, since we got married for 16 months we don't have any assets together, no loan together, no credit card account together, none of my name shew in the rental even though we moved many times but we only have a joint bank account which never have more than $50. He has he own saving before married from selling house $40,000 but I have nothing before and after married.

Anyway I offered to take off as he's till hurting his foot. We have been separated for 2 weeks already and he asking for me to sign the divorce paper for him but im afraid if I should know any important information that i need to know first?.

I got approved & received the green card Feb this year which will need to be submitted changing status I75 in Nov 2010.

In fact I just got a low pay job as a food preparing in a restaurant this week, also got the new affordable place to stay for short time while waiting until the paper work is done and I have enough savings to fly to somewhere else where I want to relocate and have a f/t job by thanks giving this year.

So my concerns are :

1. What are the important stuffs that I should know or put it in the divorce paper without paying for the lawyer.

2. If i get a job after relocate, and start to pay tax, renting my own room and have my own car. Besides my ex 's willing to sign the immigration form for me if we can agree to dissolve our marriage "on good faith" and that we can agree it didn't work out for personal differences.

Are they enough document to remove condition and get another 10 yrs greencard?

Seek legal assistance. Many areas have a legal aid society that helps people with legal issues such as divorce who can't afford an attorney. DON'T sign the papers until you find out what your rights are.

Based on what little information you've shared in your post it sounds like your husband is willing to pay for all divorce fees. If there is nothing that ties you to him as far as shared property, credit card accounts, financial issues is concerned, the I don't think you have anything to worry about. Make sure you read everything before you sign and if possible have someone more qualified, read it for you.

As far as Removing Conditions, you can file on your own based on the fact that you married on good faith. Many people get divorced under these circumstances and are easily approved. Make sure you have as much evidence as you can when you file, even if it's just statements from your joint account, mail that was delivered to your address when you lived together, pictures, etc.

I told my wife she is a lucky girl. If we divorce, she can go back to Thailand with 1/2 what we sell the house for. She will get about $50,000.

How much would you charge to be a wife for 18 months? Minimum wage is over $8 an hour. 18 months at minimum is about $20,000. Get your $20,000 before you go back to Thailand. You earned it in good faith. Don't go home broke! You did your job. Sign the papers when you have the cash.

Not too many people can pull out that much cash.... and those that can, are not giving it away that quickly....

I know somebody that even "got the money" in court but never got paied. To enforce payment is a long and expensive road especially for somebody who is not an atturney or has the money to pay for one.

Regarding I751: you have to get as much evidence as possible of/about your marriage (from the bigining to the circumstances of the brake up).

Ask the US spouse to write an affidavit stating that the marriage was for real, you lived together as husband and wife. Get affidavits form common friends or US relatives stating that they know you as a married couple (when they met you and their relationship with you)... anything to point out that you had a marriage for real and wasn't a "deal".

Regarding the divorce itself: whatever you decide to settle for in a divorce money wise ... it's up to you; has nothing to do with USCIS or I751. If your spouse doesn't have an atturney and both of you agree to split, you can get a mediator.

give him divorce if that is what he wants, prob have little choice. just dont give him a kidney. You probably be ok with immigration to stay due to you entered into good faith the marriage.

FEBRUARY 10th, 2006 VISA RECIEVED!!! They called him In via phone, stamped his passort and sent him on his way!!!

FEB 28th WELCOME HOME>>>POE CHICAGO did not even look at xray, few questions. one hour wait at Poe

march 10th marriage (nikkah at the islamic center)

aug 2006 AOS interview, cond 2 yr GC arrived september

June 2008 applied for removal of conditions on permant residency aka awaiting for 10 yr greencard

Dec 2008 10yr green card approved, no interview.

get a lawyer before you sign anything. Also, do you feel the marriage is over? If you still love him, maybe you should see if there is any saving your marriage. I would talk with him and make sure that no matter what the outcome you do split up on good terms. He might say he will do this or that and then if his friends get to whispering in his ear he might sing a different tune and tell people you played him for a green card. I do not know the man, but I would get things in writing and before you sign anything get a lawyer to look it over.

I agree with the others -- it sounds like you need a lawyer to make sure assets are divided fairly. You should also consider that you may have inadequate credit to move, get a car, etc. as you desire. Many places check your credit before they'll lease to you.

I say be careful as to why he's giving you divorce papers so quickly to sign. Catholic Charities has free or very low cost legal advice, they can hopefully help you interpret what the doc says, or what effects it can have on you.

I'm not so worried about him dividing assets equally, because that would be a battle that is just too costly for you, and he doesn't have much to begin with.

What I would be more worried about is his promise to say the marriage was in "good-faith" and your removing conditions alone. All is good now, cause he needs YOUR signature and will say what you need to hear, for you to sign the divorce. Afterwards he may surely flip sides and not help. So with that, I say gather as much as evidence as you can. I think you may have a hard time proving the good faith marriage with no joint activities. Pictures are secondary evidence, and worth less than say joint accounts, cars, medical insurance, bills-phone, cable etc. Make sure you collect whatever you can now, cause a yr from now it will be much harder...especially if you plan to move far away from him.
