Timeline
I just got back from a wonderful 12 day vacation in Norfolk, VA with my fiance :dance: , at which time we were gonna file all the K-1 paperwork (we were planning on getting married next summer in the US when he gets back from deployment). Now, all of a sudden, seems like my fiancee may get posted overseas for 2 years, and of course, I plan on going with him!!! We've decided that if this is indeed what is going to happen, we'll get married here in Canada while he is on leave at Xmas before he goes on 6 months deployment overseas.

My 2 questions are 1) I'll need to drive down to the US first with my stuff and leave from there, will they let me through at the border since I don't plan on immigrating and will be on military orders with my hubby for abroad? (I'll kind of be "in transit") and 2) Will I need to come back to Canada for my K-3 interview when we file from abroad? We'll obviously have to file before being posted back to the US. Or can I just go through the process at the American Embassy in whichever country we are living in (a good chance it may be Germany).

I just realized that perhaps I should be posting this question on the K-3 board, anyone have any feedback for me? :whistle:

I would have him inquire with his JAG office on this, he will know what that is. I am not an expert, but depending on where he is stationed/living, you will be on US property, therefore techinically in the US and will need an ID and such. The military also has restrictions on being married to a foreign national, especially if your fiance is involved in security sensitive operations. As they think he will fall under influence and jeopardize security. You will probably also have to get a visa to visit the country of his new duty station, whereever that is.

I don't know about the military point of view, however, you will not be allowed to bring your belongings into the US until you yourself have received a visa that allows you to enter with your belongings - either a K1 non-immigrant visa to marry and adjust from within the US - or a K3/CR1. You may need to store your belongings in Canada if you do end up accompanying him overseas until you have a visa.

I do think you're going to have to complete some form of US immigration Before you're able to accompany him anywhere. As someone else mentioned, even if you're overseas, technically you'll be on US soil at a US base, and can't just move in without status. You could perhaps live somewhere off-base without him, but then you'd have to do that legally thru that particular country's immigration process.

Get started now on the K1 stuff, or get married now and start the K3/CR1 and then join him where ever and whenever its completed.

August 16, 2006 - N0A1

August 29, 2006 - Touched

Sept 7, 2006 - NOA2 as per USCIS website ~ Approved in 27 days!

Sept 13, 2006- Received N0A2 by mail

Sept 15, 2006- Received letter from NVC dated Sept 13 that case will be sent to Montreal within a week

Oct 2, 2006- Received Packet 3 from MTL!

Oct 11, 2006 - Mailed back Packet 3 to MTL

Oct 19, 2006 - MTL received Packet 3

Nov 15, 2006 - Medical appointment in Ottawa

Dec 22, 2006 - Received Packet #4

Jan 25, 2007 - Interview date @ 14h30

Jan 4th 2007- Phoned MTL Consulate to reschedule interview for late April due to Navy deployment
