I respectfully submit that, only YOU can answer this question. Good luck.

I personally feel that your marital problems "from day one" and "on and off" separations are definite indications that your marriage will not last. When you entered my country under a fiancée or spousal visa, you made a sworn statement that you were entering into the United States (and your relationship) in good faith, yada, yada.

I have to respectfully say that an honorable individual in your position would return to his home country and not attempt to deceive the DHS for the sole purpose of staying in the U.S. There are already way too many immigrants coming in to the United States that do not live up to the conditions of their agreement/visa and every one that files anything (AOS, lifting of conditions, goes to interviews, or whatever) slows the progress of the honest people that are truly in love with their fiancée, husband, or wife and are in OUR country for all the right reasons... those people deserve to be here.

my thoughts to you is this.. file for divorce (or annulment) and go back to your home country, if someday you are as blessed as I have been to find a kind, understanding, loving, and beautiful wife and she happens to live in the U.S. then enter for all the right reasons.

What interview are you referring to??

There is no room in this country for hyphenated Americanism. When I refer to hyphenated Americans, I do not refer to naturalized Americans. Some of the very best Americans I have ever known were naturalized Americans, Americans born abroad. But a hyphenated American is not an American at all . . . . The one absolutely certain way of bringing this nation to ruin, of preventing all possibility of its continuing to be a nation at all, would be to permit it to become a tangle of squabbling nationalities, an intricate knot of German-Americans, Irish-Americans, English-Americans, French-Americans, Scandinavian-Americans or Italian-Americans, each preserving its separate nationality, each at heart feeling more sympathy with Europeans of that nationality, than with the other citizens of the American Republic . . . . There is no such thing as a hyphenated American who is a good American. The only man who is a good American is the man who is an American and nothing else.

If things are that Bad file for divorce and then file a waiver. Do you have joint things together? Why live in this situation?

You should ask this question in the "Effects of Major Family Changes" forum but make sure and give specific info if you do.

As many people have said, MOST people do not get called for an interview. IF you should happen to be one of those people, I would go to the interview anyway, even if your wife is not present, and then explain your situation. If you are divorced or legally separated by then, take those documents to show them. If you get divorced, you will have to file again with a waiver. Don't just not show up for an interview though .. that's bad news.

21 months is more like lifting conditions, if you already waited a few years, you are already illegal. Go back to your home country, would be much easier.

I don't see any reason to suspect that this OP is a troll. He is in the same situation that many people are in. Many people marry ... whether it be a case of an international relationship or not ... and discover that the marriage is not what was expected. USCIS makes provisions for folks who get divorced. The OP is in a grey area.

Take my advice OP... post on the Effects of Major Changes forum. You will find others there in your situation.

Oh.. and if you think someone is a troll ... posting to a topic is an easy way to fan the flames. It's better to say nothing and just let a thread die.
