Folks,

My wife is having her citizenzhip interview on sep 17th 2009 at 11:10 AM. We heard that intake for I/V is till 11:30 AM.

1.Is there any possibility if she can take oath on the same day (if she pass the I/V) or will she have to wait for a date given by authorities....?

2.We need to file for I130 on the same day as instructed by the attorney. If oath is delayed, will our filing also needs to be on hold ?

Pls help with your advices....

Thanks and regards

Aby & Amy

You have not provided your local office information. Some offices do a same day oath like atlanta or newark around 1:30 / 2 pm so if your interview is before 12:30 you have chances to take the oath on the same day IF it's common procedure with your local office. Unfortunately, most offices do not offer the same day oath, after the interview an oath letter is sent out. This can take between 2 weeks and 3 months depending on the speed and efficiency of the office. I do not believe an I130 can be filed without proof of citizenship: certificate of naturalization IF you wish to file as a citizen. If oath is delayed, filing is delayed too. Unless you file with the Green card, which you only surrender at oath time. But I dont suppose that's what you want to do?
