Changing last name of my Filipina Fiance's child

Timeline

My fiance' has sole custody of her son as stated on her annulment. Once in the US and we are married we want to change his last name to mine so all will share the same last name. Does anyone know the procedure for this? Does it require adoption of him in US? I would like to hear from someone who has been through this.

:unsure::unsure::unsure: , yes i think in ur case.. if u want to change ur fiancee's child surname to urs then u should adopt him.. pls. seek attorney's legal advice... :)

May 15, 2017: NOA1 
June 05, 2017: Biometric Done
June 19, 2017: Case is in Line for an Interview
June 25, 2018: USCIS Scheduled an Interview
Aug. 02, 2018: Interview Date- APPROVED!
Aug. 09, 2018: Oath Ceremony

Happyme is right, you need to adopt your fiancee child if you want to change the surname. My husband will adopt my son so my son can use my husbands surname and that is also my lawyer told me.

Aug. 21, 2009 - I-130 APPROVED

Sept. 01, 2009 - NVC received & case# assigned

Oct. 19, 2009 - Log-in FAILED (YEPEE!!!!)

Oct. 20, 2009 - Case COMPLETE!!! (confirmed by the NVC operator)

Oct. 27, 2009 - Interview Date assign(By NVC operator)

Nov. 16-17, 2009 - Medical PASSED

Dec. 04, 2009 - INTERVIEW(APPROVED!!!)

Dec. 08, 2009 - Visa pick-up at the Embassy

Dec. 16, 2009 - CFO

Dec. 19, 2009 - My Flight - POE (JFK New York) via NWA

Can't you just change his name when you adjust status? Sure can for the wife.

I adopted my stepdaughter tho.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Legal adoption in the Philippines (where the boy was born) would take about a year or longer, depending on the circumstances.

You can only adopt the boy if the natural father willingly relinquishes his parental rights over the child or if the natural father has passed away (in which case your wife would allow the adoption to take place).

Better to consult with a lawyer.

02-23-2018: Date on NOA, retrieved from online account

02-23-2018: Date on Biometrics Appointment Letter (Biometrics Appointment at Jacksonville ASC on March 13, 10:00 a.m.)

03-08-2018: Biometrics complete

04-05-2018: Case status updated - Interview Scheduled on May 10, 2018, 10:15 a.m. :D

05-10-2018: Citizenship Interview - Passed English and Civics Tests, Recommended for Approval! :D 

06-19-2018: Received email and text notification: Naturalization Ceremony Scheduled; waited for letter to be uploaded on online account - it has been set on Wednesday, July 25, 3:00 p.m.

07-25-2018: I am now a U.S. Citizen!

I think RP government may have changed the requirements recently but before you had to have physical and legal custody of the child for 2 years before adoption approval. Means you have to live there for 2 years. May have changed tho.

Look up the legal name change info on minor children on your District Courts website.

It is possible without adoption here in WA,
