Now does my fiance, who is American have to order the fiance visa application from USCIS and get them to mail it to his address before we can fill them out? Or can we just fill out the forms online, print them out and send it away with our Cheque or money order?

Fill them out send them. There is nothing to order.

Yes, the guides are very helpful. Basically, your US fiance will file an I-129f petition along with the requested supporting documents. He will send it by mail - use a method that can be tracked so he knows when it arrives. He will include either a cheque or a money order - his choice. He will receive a receipt for the petition (known as NOA 1 - notice of action 1). When the petition is approved he will receive NOA 2. That means he has received permission for you to apply for a K-1 -Fiancee - visa. The application process then moves to the US Consulate in Canada (Montreal if you live east of Manitoba, Vancouver if you live Manitoba and west). They will send you a package telling you they have received an approved petition and inviting you to apply for the K-1 visa. It will include all of the instructions about what you need to do and what you need to fill out. When you have everything that you need, you let the Consulate know and they schedule you for an interview at the Consulate. If your interview is approved you will receive the K-1 visa which is physically attached to a page in your passport. The visa is good for 6 months - so you can use it anytime in the following 6 months. Once you use it to enter the US you need to get married within 90 days and apply for permission to remain in the US - called Adjustment of Status II-485).

So, that is a brief summary of what you can expect. Both stages of the fiance visa process will take several months and you will find lots of support and useful information here on Visa Journey to help you while you wait and go through the process. So now, you'll want to read the guides at the top of the K-1 visa forum - here is another useful link: http://www.visajourney.com/forums/index.php?showtopic=300

Good luck and congratulations on your engagement.

Good luck.

I forgot to ask Can I send them the cheque for $455? My bank is Royal Bank of Canada. Will they accept that? I prefer to send a cheque to see when they cashed it. Can my fiance fill in his part of the forms in pen?

The cheque has to be in US funds and drawn on a US bank so the Royal Bank of Canada cheque would not be accepted. The forms can be filled out in pen - it should be either black or blue ink.

A lot of people prefer to send cheques for the very reason that you can see when it is cashed. What is also useful for almost all of the immigration process is that USCIS writes a case number on the back of your cheque as well and you can often see what this number is even before you receive the NOA1 receipt. With that number you can set up an online account with USCIS that updates when something significant happens to your file and that you can check for yourself. The cheque does, however, have to be from a US bank.

Oh thank you very much. Once we send it in Im going to create a time line. I think I will fill out the forms with him online and send him mine plus his so he can sign his parts and send it all away.Thank you so much for your help!
