Hi all;

Thanks in advance to everyone for ongoing suppport. I have done some research and would like the following clarified :0)

1) My fiancee (the petitoner and U.S citizen) has 3 children living with her and therefore when i arrive my assumption is that her household will be 5. Her, 3 kids and me. Is that correct?

2) If # 1 is correct then the petitoner has to prove that she earns $32,237. Is this correct?

3) Is the $32,237 Gross. I.e. Payment that she gets before taxers etc.

4) She has had this job for about 4 months and her last job payed less. Therefore her previous tax returns would not show that she can support me. Therefore if she takes her last monthly pay stubs and multiplied them up, would that be sufficient proof?

5) A letter from the employer can be attained and although this is a full time job, there is not much in basic pay. It is based on the work she does (she grooms dogs - the more and harder she does the more she is paid - and the last 3 months projection does pur her above the line - but not by much :0) ). Do we get her boss to simply write that she is working full-time, for this length of time and her pay is this? Or should we say projected pay? I dont want to lie or open up potential cans of worms :0)

6) It says 2 out of 4 evidence is required. We can get Monthly stubs and a letter from the employer. Is this enough?

7) Her bank balance is at zero (not in debt but no savings). I dont think this evidence helps out case. should we leave it out?

8) Her last tax return / W2 will not show that she is abov the line? Shoulld we leave them out and just go with the 2 bits of evidence that do?

9) I the beneficiary in the UK, have savings and it is ironic that she really doesnt need to support me as we have money for at least a year, if not longer? Should i present any of this informatiuon in Packet 3 as evidence or again could it cast doubt on the Petitioners ability to support me?

Yes, 5.

Yes, more if in Alaska or Hawaii. Less if she's active duty military.

Previous year's tax returns may/may-not match what her current income is - Pay stubs will be annualized to calculate current income.

If you're concerned about the letter, don't get one.

Letter of employment is not really required - but the pay stubs and most recent year's tax return (with all supporting documents) is or will be needed.

This is optional - no need to disclose this information, especially if income is sufficient.

Tax return and supporting evidence (such as W-2's) is required.

Not really - if your fiance is qualified on the basis of her income, no need to go down this path.

4. Yes, they give weight to current income, just verify it with recent check stubs and maybe an employment letter

5. Don't lie. I am not sure how much the boss will verify as income. If he can quantify her tips, fine. She should also be depositing her tips in her bank account and then use a bank letter to show deposits (current balance is not as important as amount of deposits which indicates income)

6. Consulate specific, if that is what they say, then I would think yes

7. bank balance is not important. If her account shows enough deposits for the year it can help verify her income

8. Lasty tax return is not as important as current income, work on verifying that first, nothing you can do about the past

9. You can present anything you like. The consulate does not have to acceot it but they ARE allowed to if they choose. They can even consider your employability in the US. It is a judgement call made by the consulate. I have read where London has been pretty agreeable to these things in the past, can't say for sure, but you have nothing lose by trying

Not really - if your fiance is qualified on the basis of her income, no need to go down this path.

Really great reply. Yep, make sure can prove income above the line and concentrate on a case for that. Any evidence to show that i have money too may be dismissed but at least it wouldnt harm. Thanks again

I am married to a LPR. I got the NOA2 and now we are filling in AOS, which the lawyer will submit in a couple of weeks. Does anybody know how long it takes to approve AOS after it has been submitted? thanks
