Ok.. One last question here.. Both John and my soon-to-be-father-in-law (the cosponsor) are self-employee owning THE SAME business. Can they present joint tax returns or do they have present separate ones?

ROC Timeline

8/1/12: ROC window opens
9/4/12: ROC packet sent
9/8/12: ROC packet delivered to VSC
9/12/12: Check cashed
9/14/12: NOA letter received (NOA dated 9/10/12)
9/20/12: Biometrics letter received (Bio appointment 10/15/12)
10/12/12: Early biometrics walk-in

4/27/13: RFE received

6/17/13: RFE response sent

7/1/13: ROC petition approved

7/5/13: GC received in the mail.

HEY!!! I HAVE A QUESTION FOR YOU THAT I HOPE YOU CAN HELP ME WITH. OUR CASE WAS APPROVED RECENTLY AT THE NVC AND NOW OUR PAPERS USA EMBASSY IN COLOMBIA. MIKE AND ME ARE CONCERNED ABOUT ABOUT THE I-134 REQUIREMENTS SO WE DECIDED THAT WE ARE GOING TO PRESENT A CO-SPONSOR (HIS MOM) SO WE AVOID ANY KIND OF ISSUES WITH THE EMBASSY. THE QUESTION IS WHEN AND WHERE DO WE PRESENT IT? SHALL WE SEND IT TO THE IMMIGRATION OFFICE? HELP PLEASE!!! :unsure:

The consular officer does have discretion with K visa applicants, as you read in your visa book. As Gary pointed out, they have to determine whether there's a risk your fiance will become a public charge in the US. The I-134 is used by most consulates for K visas only as a convenient means to summarize income and assets, but the form itself proves nothing - you must provide evidence for everything you claim on the form. Most consulates apply the same rules with the I-134 that will eventually be applied with the I-864, since the I-864 is the real commitment by the sponsor. Most consulates will accept an I-134 sponsor if they meet the I-864 minimum requirements.

If you think there's any chance you'll need a co-sponsor, then get one. Present the co-sponsor's I-134 and evidence at the same time you present your I-134 and evidence, whether it's mailed in with packet 3 or submitted at the interview. Nobody has ever been denied for submitting a co-sponsor and not needing it, but many have been denied for not having a co-sponsor when one was needed. The time when the co-sponsor is needed is when the documents are submitted, and NOT after the decision has been made.

I'm the petition fiance, Definitely I would needs a co-sponsor for my Foreign fiancee and I know that my co-sponsor and I each one of us must fill out forms I-134 Affidavit of Support and supporting documents. My question is, does the co-sponsor is sponsoring the same person which my foreign fiancee on I-134 Item #3 This affidavit is executed on behalf of the following person? or my co-sponsor is sponsoring me directly and NOT to my foreign fiancee. Thank you so much for clearing this confusion and unfortunately I was not making enough last year because I had spent a lot with my fiancee overseas.

Sorry this got missed for two days. :blush:

Unless John and his father are married ( :blink: ) they cannot file a "joint tax return". The may have a separate tax return for their business - it depends on how they classify their business. However, each will have their own personal tax return. It is the personal tax return they have to include with the I-134. This is something they must prepare every year for the IRS, and not something they conjure up for the visa application. Whatever they filed with the IRS most recently is what they'll have to submit. If they have a separate tax return for the business then they do NOT submit that with the I-134. The consulate doesn't care about it - the business isn't sponsoring the immigrant.

If that wasn't clear... John will include HIS personal tax return with his I-134. His father (your co-sponsor) will include HIS personal tax return with his I-134. Since they are self employed, it would much much simpler if they just call the IRS and get transcripts for their tax returns. If they submit the transcripts then they won't have to include any of the supporting evidence they included when they sent their tax return to the IRS. If they don't get the transcripts, they'll have to include a copy of their complete tax return, including all schedules, attachments, and supporting evidence, just as it was submitted to the IRS.

I have no idea what you mean by "immigration office". Most consulates require you to submit the I-134 at the interview. If you're going to have a co-sponsor, then you also submit their I-134 at the same time. Follow the instructions you get from the consulate.

You are sponsoring your fiance. Your co-sponsor is sponsoring your fiance. Both of you should list your fiance on item 3.

You are sponsoring your fiance. Your co-sponsor is sponsoring your fiance. Both of you should list your fiance on item 3.

Thank you so much for your info, that's what I got so confuse, I knew I'm sponsoring my fiance and I thought my co-sponsor is sponsoring me.

Again, I'm still searching for someone can co-sponsor me for this journey to an end. I just wanted my fiancee be granted for Visa, that's all what is matter now. But so far I have no luck of finding out Mr. or Mrs. Nice to help me co-sponsor. I could not believe how difficult is our economy here at home, usually I would get a job much easier. Anybody in this forum that has a good heart, please help me be my fiance co-sponsor or find me one. This is very difficult time but with God's will, we will get through this but as of now, my time has run out quick if I don't get co-sponsor. :( So help me please? I needs someone who makes between $28K to $35K in their income tax 2008. Thank you so much...guys!

:blush: I need to make sure about form I-134 please!!! In the instruction were given it said that no need to notarize it. Can somebody verify this? do I need to notarize it or it doesn't needs to be notarize at all. Please respond thanks... :wacko:
