Please HELP!!

Timeline

Needing some advise on our DS-230. Our DS-230 has been turned in already. On the last part of the DS-230 where it asks if you have ever been arrested we put No. My wife got her police certificate back an there is no record. Now my wife and her friend had shop lifted about six years ago. My wife was issued a citation for being with her friend. MY WIFE paid the citation and the case was closed.

Now before our interview should we hand a new DS-230 over explaining the situation about the citation even though her police certificate says nothing???? We are sort of worried about not explaining in the DS-230??????

PLEASE HELP.....

As advise... You and your wife should not tell about citation anymore, there's no record in her police certificate. the more you tell about the more will be complicated. US embassy are very strict about having trouble. It is just my advise

Sept. 01, 2009 - NVC received & case# assigned

Oct. 19, 2009 - Log-in FAILED (YEPEE!!!!)

Oct. 20, 2009 - Case COMPLETE!!! (confirmed by the NVC operator)

Oct. 27, 2009 - Interview Date assign(By NVC operator)

Nov. 16-17, 2009 - Medical PASSED

Dec. 04, 2009 - INTERVIEW(APPROVED!!!)

Dec. 08, 2009 - Visa pick-up at the Embassy

Dec. 16, 2009 - CFO

Dec. 19, 2009 - My Flight - POE (JFK New York) via NWA

I offer not advice, but query: was she ARRESTED or just issued a citation? You are only required to disclose actual arrests, not every "ticket" or "citation" (no matter what for).

She and her friend were taken to the police station for finger prints. Then released to pay citations. the case was closed and my wife received the citation and paid it. She did receive a police certificate. Does anyone think we should fill out another DS-230 before the interview and disclose this just in case?

Well, first of all never lie However, if the police certificate doesn't reflect the citation and your wife wasn't actually arrested, then I bet you're fine. The question specifically refers to arrests. If it's really bothering you, I'd suggest having your wife call the police jurisdiction involved and ask if they considered it an arrest. I bet they'd say no though. I think you're fine!

Our timeline:

2/88: We met in Sydney, Australia at a youth hostel! He's Finnish, I'm American-both were in our early 20s at the time and fresh out of college (so couldn't afford to visit each other's countries after that!). We had a three-day romance, then went our separate ways. He actually was going to Sydney a week later, but decided at the last minute to cut his trip short in another country and go early. Wow.

1988-1998: Wrote "snail mail" letters/sent Xmas cards, but lived our separate lives. I married someone else, divorced in 2006...he lived with someone for years and then that ended.

10/08: Because of a series of random life events, I Googled my Finn Man and found him (but no link to his email, and the website his name was on was in Estonian so I couldn't even read it!). It took me two weeks to find a link to someone else, who forwarded my email to him (we were both single at the time thankfully!!!!). The email went to his spam folder but he happened to check it that day and responded back to me immediately! This was after 10 years of no contact and almost 21 years of not seeing each other after we first met.

11/08-5/09: We traveled back and forth to visit each other. Love at first (second?) sight!

7/09: Married in Helsinki, Finland...after meeting randomly 21 1/2 years ago and finding each other again!!!!!

8/13/09: I-130 sent!!!!!!!!!

A citation is not an arrest, that is why there is no record.

She did not go to jail, she did not go to court, so in this order - NO, she does not have a criminal record. Don't worry about it. If police certificate says NO CRIMINAL BACKGROUND, then you're fine! Good luck with the rest of the process :thumbs:

If it was only a citation, I would not say ANYTHING... If the police record is clean and she was not actually arrested, then I would not bring up anything to warrent additional attention... Just my opinion. They want to know about ARRESTS not Tickets...

Thank you for the advise. I leave this morning to Colombia to see my wife and attend the interview. I hope to return with my wife and the visa. this case could come to and end with a great success and ending.
