Timeline

has anybody had any experience with appealing I-130 denial? how long does it take?

I have hired a lawyer to help me appeal the denial of my wife's I-130 due to lack of prove of our marriage.

we have sent our appeal to california service center in Aug,18 of 2009. they are supposed to foward it to the Board of immigration. so if anyone has done the same thing in the past. please give me an idea of how long we can expect to hear from them.

I have no very informative information about your situation, however I wish things move faster and may you have more patience and strength as you go through this process. :yes:

what proof did u send initially?

I864 delivered November 2nd.....nvc logged it on November 5th

DS230 delivered November 6th.....nvc logged it on November 12th

Welcome to US Letter May 19th

Card production ordered May 25th

I sent in the wedding pictures, letters from co-workers and friends, phone cards, money wiring receipts and prove of my two trips to kenya to visit my wife. I guess they did not like our pictures and they said they do not look like wedding pictures.

Did you send in your marriage cert? You don't list it and if you did not send it in, that would be clear cause for denial. JUst trying to figure out if your denial was based on "lack of evidence of marriage" or "lack of bonafide marriage".

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Did you send in your marriage cert? You don't list it and if you did not send it in, that would be clear cause for denial. JUst trying to figure out if your denial was based on "lack of evidence of marriage" or "lack of bonafide marriage".

I did send in the marriage cert. I think the denial is for lack of bonafide marriage.

I am sure a more experianced member will correct me but .. if a petition gets returned I believe it waits 6 month before being processed. Not 100 % jut 80 % sure ... ask one of the gurus they are always full of information.... :blush: wish I could help more

Hey, did they return all your documents or they sent Notice of Denial right away? Our case status online says "document" was mailed to applicant (my husband) and until now he still didn't receive it so we're wondering what document could that be..Thanks.

December 10, 2009--Interview @ 8:30AM A-P-P-R-O-V-E-D
January 25, 2010--FLIGHT(Manila-Japan-Detroit,MI-Buffalo,NY)
February 22,2010-- 2-yr GREEN CARD received
February 26, 2010--SSN received
REMOVING of CONDITIONS
December 22, 2011-- I-751 mailed
February 28, 2012-- Biometrics done

October 10, 2012-- 10-yr GREEN CARD received
NATURALIZATION
January 09, 2013-- sent N-400
January 28, 2013-- Biometrics

May 22, 2013-- Interview Passed- Officially a US Citizen!

I'd call my senator. Mine has helped me a LOT. Mine did find out the exact reasons we were denied.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

our case was denied march 2009,,, we have our option to appeal but we chose to refile. now we got our approval noa2. there are no assurance on how long it takes..... message me..im willing to help....

no they did not send back any of my documents just the NOIR.
