Timeline

we finally got our Rfe on aug 27 but it was due on the 28th aug,she sent it in on the 28th. we sent the post dated from the envelope to show that we just received the Rfe. we had to request them to resend the Rfe cause it was sent in july and we never received it , now a week later i got a notice email from cris saying they are sending a denied form to us? ya think they even got to look at the info we sent in yet.

Did you send a letter of explanation with the envelope showing the date? I would call USCIS and have them open a service ticket and explain the situation, hopefully when they get the RFE they will see the service ticket on the problem.

What did the RFE request? What did you send? I cannot tell you if they denied because of missing the date or if they denied because what you sent was not what they needed. Do you have delivery confirmation they received your documents? Given the timing you suggest, I say they never got what you sent. A week is not evough time for the USCIS to decide anything other than "he didn't respond" NEVER, EVER send anything to USCIS without delivery confirmation. Hopefully she also included a letter of explanation as sending an empty envelope will only confues them and proves nothing in itself, and hopefully she sent a COPY of the original envelope and not the original.

I do not think you are dead in the water, but if they did not receive your response you may have to go about getting the case re-opened, showing the RFE arrived late, proving yousent the response in time (and hopefully the response is what they wanted)

What did the RFE request? What did you send? I cannot tell you if they denied because of missing the date or if they denied because what you sent was not what they needed. yea i'm thinking they didn't receive the info yet , I have to talk to sarah tonight to find out how she sent it all, i'm just heart broken at the moment and on top of this i'm suspose to be going down next week to visit her for her b-day and take her to a football game. Now I hope i'm able to cross the damn border.

A birth certificate is adequate proof of citizenship, provided she didn't send a copy of a "short form" birth certificate card, and that she provided copies of both sides of the certificate, even if the back side is blank. A copy of her Social Security card proves nothing.

In responding, she should have sent a copy of the entire envelope, and not just a clipping of the "date". You could cut the canceled postage stamp off the corner of any envelope. It would prove nothing to USCIS.

we been together for over 9 years and for the last 2 years she sent in a ticket stub for commin here last year, i have hotels stubs from when i go down,we sent in lots of photos from bunch of times we been together in the last couple years and a whole pile of other things, but they just wanted to know alittle detail about how we met, i guess when she filled out the one question it was alittle short or to simple for them. and she copied both sides of the birth certificate twice now.

they sent us a notice saying that they were gonna resend the rfe and we got it one day before it expired

it stated VSC only but Your case may be one of these cases.

VSC just advised AILA of about 1000 Requests for Evidence (RFE) that were prepared, but erroneously not sent. These RFEs are dated June 4, 2009. Approximately 300 of these cases were denied based on abandonment. However, VSC will re-open on service motion, and re-send the RFE. If a motion was filed, VSC will refund the fee.

Please do not file a motion for denials based on abandonment if it appears the RFE was sent on June 4, 2009. If you do not hear by August 31, 2009, please alert AILA.

VSC believes this snafu was isolated to June 4, 2009.

The I-129F only asks you to describe how you met in person, and to provide evidence of that meeting. This is to prove you've met the requirement of having met face to face in the past two years. I can't tell for sure what evidence you provided from your description, other than a "ticket stub" (I assume you mean boarding pass), some photos (secondary evidence), and whatever a "pile of other things" is. The specific wording of the RFE is critical, though. Was it lack of evidence proving you met, or was it lack of a description of the meeting? For a description, USCIS only requires a sentence or two; e.g., "I flew to Canada to see my fiance on June 1, 2008. We spent a week together in Winnipeg." Many people provide much more detail, but this is more for the benefit of the consulate later on. USCIS doesn't require it.

About the birth certificate, was it a certified copy (or photocopy of a certified copy) of the "long form" birth certificate, or was it a short form? A short form is usually a computer printout of the birth record information from the State where she was born. These are usually NOT acceptable as proof of citizenship for USCIS because they are easily forged. A "long form" birth certificate is an actual copy of the original form prepared at the time of birth, or a photostatic copy of that form produced from a microfilm record, with a stamp from the State Board of Vital Statistics affirming it's authenticity. It will typically have the signatures of the attending physician and the mother, and sometimes also the father. Lacking this, a copy of the entire US citizens passport (including blank pages and covers) will serve as proof of citizenship.
