Petition Parents on tourist visa

Hey I want to file a petiton for my parent who are here on tourist visa. They came here in June. They applied and received their tourist visas last year. I recently go my citizenship last month.

What is the process? Anyone have a flowchat? I'm thinking if my parents decide to stay, it's a matter of doing the I130, I485, etc at the same time.

or If they go back to the Philippines, it's the I130, then processing in the Philippines?

The I485 is quite pricey.. Is it least costly do file the I130 and have them do the visa processing in Manila?

Please advise.

less costly for the I-130 & visa than I-130 & I-485 by a few hundred dollars

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

All based on whether the benificiary is eligible for an immediate visa number... A USC petitioning for a parent is in the immediate category.

Any USC can file for I-130 and AOS for an immidiate relative (spouse, parent or minor child) as long as they did not enter the US with the internt of using a tourist/VWP visa to get around the immigration laws.

They could be asked to provide evidence that they did intend to return to their home country when they go to the AOS interview. This route is use by 1000's every year.

99.99% Get approved with no questions asked about intent, but there has been cases where other things have raised a red flag and then the interviewing officer asks about their entry and what they told the POE officer and what there intent was at that time.

What i'm trying to articulate is that they got their tourist visas and entered the United States prior to me applying for my USC application. I recently got my naturalization and the subject came up when my father asked about possible staying.

Does anyone have a flow chart or good documentation on the I30/embassy process vs the I130/I485/I765 process?

You can use the guide that was written for spouses it is the same process you just dont need to do the biographical forms or include evidence of marriage.

So where it reads spouse you read parent.

They came in June, you got ur naturalization last month, when did u apply for naturalization? july?

They got their tourist last year Nov, I applied USC in Apr and naturalized in AUg. They arrived also in Apr.

I guess thats what I was thinking would be hard to prove ie- not plausible. Like, with a spouse..people are like "oh, lets get married!"... "on a whim" and then adjust. With a parent, it just seems like it would be difficult to prove they didnt come to stay. What kind of justification do you use to adjust,as a parent? "I dont want to leave my kid" is the only thing i could think of. sorry, just thinking outloud.

Everyone said, people do it all the time so i guess they most certainly do.

The reason to adjust is because all of a sudden (with the naturalization) they became eligible and could.... prior to that the option was not available, so once it was they made a decision.....

I see. So, to disprove intent you would just say "we didnt know we would still be here when she/he became a citizen, she did and so we decided to stay"

I am asking because your posts are contradicting. First you say they came in june.... then you said they came PRIOR to your application for naturalization and got your oath in august. Now you say they came in April. To avoid confusion and for VJ'ers to assists you better, i suggest you edit your original post.

If you want to save money, do visa processing in manila. If you want to save time, do AOS here.
