It's my first time posting.

So long story short.

My mom married a US citizen last July and filed for I-130 in August. At the time she was under the immigration proceeding and currently is still in the proceeding. They had an interview with an immigration officer in January of this year, 2009. At the interview, the officer told us that it was successful and I-130 will be approved. We waited and waited but have not heard anything at all. We have a hearing regarding my mom's proceeding in September, and recently found out during InfoPass appointment that her I-130 case has been administratively closed in June.

So, can we reopen I-130 case and get it approved? Or does it need to be refile all over? What can happen at the hearing for her proceeding? Does anyone have any experience with I-130 case getting closed without any notice or clear reason?

have you called USCIS? or made another InfoPass Appt? Gotten in touch with your congressman/senator? that sucks...sorry to hear :(

Timeline:

Sent in I-130 form: 01/29/09

Interview Date: 11/08/09 (APPROVED!)

Visa in Hand: 11/12/09

POE: 01/30/10 (!!!!) at JFK Airport in NYC... can't wait!

Got the green card maybe 8 weeks after 01/30/10...

TBC....

You should contact USCIS as soon as possible. Your case is so strange for more than one reasons; After I130 has been approved then your case should be sent to NVC, who in return should contact you or attorney.

My lawyer is writing to the officer who did the interview. But it seems to me that she's not really responding to the letters. I'm going to go for another InfoPass appointment.

Just to be clear, we didn't receive any notice on I-130. no approval notice. no administrative closure notice. even though at the end of the interview, the officer told us she approves the case.

-- My wife and I had the same situation arise, we filed back in 2006 and processing time in Tampa was running over so they just cancelled the file and lost it. Since she was in removal proceedings the prosecutor in Miami had the file reopened and transferred over to West Palm Beach. We went in December '08 for our interview, the interviewer indicated there was one more piece of evidence he wanted to see which we provided in a timely manner, and then nothing. What I am doing per a USCIS supervisor's suggestion is refiling our I-130 with additional evidence including all the paper from our previous filing. Have you had any luck in your situation?
