Is having a baby more difficult at the POE when vsiting?

Hi there guys. I had an account on here for almost a year, maybe some of you remember me or not... Stiggy. I just cant remember how to make the heart before and after my name again (Im lame, I know).

Last I updated you we were going to do a CR1 after we were to get married in 2010. Well.. things have changed. Im pregnant and due before then, so we pushed the wedding date back since I want to work off that post-partum bely flab before I get in a wedding dress. So hopefully we will marry in the late Spring. And instead of doing the CR1 route, we have decided he's going to move up here to Canada ... better economy (I think?), my parents are retiring in early 2010 and theyre the very active hands on type grandparents who want to watch the kids while we are working and all the other little benefits such as child tax benefit, free healthcare, etc). Also because my exhusband still refuses to allow my son and daughter to move to the US (the only time he agree'd was if I were to drop his child support payment completely last winter)

My fiance is the American, Im the Canadian. And the newest news is that we are currently expecting our first together, a little girl

Not the last time I went to visit, but the time before that I was hounded at the POE regarding my visit. Probably because I didnt have a job at the time. I almost thought she wasnt going to let me through, until I told her I had a 3 year old and a 5 year old that my exhusband was watching while I was gone for the week.

Now, Im living in the GTA and moved out of the maritimes. Im trying to get back on my feet after being a stay at home mom for 6 years. Im temporarily living with my parents until Dave's immigration stuff is finished for him to come up here. And I got a part-time job. Once our little girl is born, Id like to bring her down South to see her Daddy as much as I can and see her paternal family too. Im wondering if anyone has experienced or thinks Im goign to have even more trouble now crossing over knowing I am pregnant/ have a newborn with an American citizen and they think Im just going to stay down there, even more than before?

Hi Stiggy and congratulations!

No, I don't think you will have a harder time. As you discovered, the proof is ties to Canada that you present at the border, you need to have those.

You don't mention when you are going to apply for his Canadian PR? Once you have done so, bring proof of filing with you as well, so they know he is moving here, rather than you attempting to reside in the U.S.

Thanks Trailmix No more moving to the nice, sunny Florida heat .. was kinda lookin forward to it .. I'll be cursing come December lol.

Dave's currently working with a contract for the government for a few more months. He wouldnt be able to move here until March, so we will probably put in the papers in October and file him Outland since its faster since he cant be up here anyways right now due to work. Then when his contract is done, hopefully everything will be ready for his PR so he can move up here right after and start looking for a job. I'll definately keep you updated!.

I guess the only thing I can bring for proof of ties (since I guess they will scrutinize me even more now) is a letter from my work stating when I have to return back, and if Im on mat leave by then hopefully a letter from unemployment showing Im on mat leave and a letter from my employer stating when Im expected back to work... since I have no rent, no car lease, etc. But I never thought of bringing a copy of the Canadian paperwork once I start that... once I get it I'll definately bring that too

Another thing that might help you if an affidavit from your parents perhaps just stating that you live with them, that they are taking care of your kids and expecting you back on a certain date (whatever the case may be). That could definitely help...

Oh and - you probably already realize this, but you will want to either do a registration of birth abroad (of a U.S. citizen) or alternately get your Daughter a U.S. passport, for when you travel with her.

Yah we contacted the US consulate... it takes a while for the birth abroad. I need to wait until the statement of live birth is sent in, then wait for the birth certificate to come back, apply for the long form birth certificate - then we can go to the consulate in Toronto and do the report of birth abroad which takes about 2 months after that. So Im assuming by the time I can travel with her, shes going to be almost 6 months old?

I read the subject of this thread and had a vision of a very pregnant woman birthing at the border. Not the way to get dual citizenship in my mind. Good luck at with you baby.
