My wife got her k3 visa back in december 08, 9 months ago. They took her medical record report then and opened it at this interview. Now we have gone to get the CR1 Visa in Turkey again (I could not do this in the U.S. as the CBP officer never gave me an I-94 and they took her birth certificate at the K3 visa interview and I struggled for months to resolve this finally giving up on the AOS in the U.S.) and in her interview today for the CR1 visa this was the ONLY thing missing cause we previously gave it for the K3 visa. So of course they were not understanding and said we had to retake the test because it was "more than one year old", it is only 9-10 months old though.

In the end, they gave her a green paper saying the missing things she has (they did this for the K3 too) and on it says to re-take the medical test again and send it in. The disgraceful person at the window said that there is no telling when her visa will come out after that even, two months to six months they say even though she already has plane ticket back. They also say she cannot leave the country back to the U.S. on the K3 visa until this is taken care of?!!

We are so unbelievable disgusted with this as just another great upset by these Nazi workers. I am going to seek legal actions and sue the U.S. Embassy in Ankara, USCIS and the NVC. That will go in another post, I am just so fed up with this trash.

Does anyone else have a similar case, any advice on what to do? Can they even do that, the K3 visa was received only 9 months ago, why does she have to retake the medical exam? Can she just get a copy of the old test from the Hospital she took the original test (THAT THING IS EXPENSIVE)? She is pregnant and shouldn't even take any x-rays! She went all the way from California to have this done to her. She said she is about to lose the baby, God forbid, she is so upset and sad.

I am so sorry for your situation. Sadly yes, the medicals do expire and I think it is country sepcific as to the time (varies from 6 months to 1 year)

Advice I can give is this, take the medical again, submit it ASAP and have your wife back in the US as soon as possible. If they are asking for a new medical, I doubt you can just get the results from the previous one. You can work hard on calming your wife and relieving her stress as much as possible to protect her and your unborn child (that should be priority one at the moment).

As for suing USCIS, NVC and the embassy - I know you are frustrated but I can guess that your wife will be back in the US before the lawsuit is resolved. Focus on your time, money, and energy in protecting your wife and child.

Thanks. I wish I could be there but I could not get off work, I will be joining her 16 days.

Hopefully she can take the medical exam a.s.a.p. (there was a one week waiting list last time) and then send it and we can get the visa back before our flight back on October 11th.

First you have to be human, they don't think this woman is pregnant came across the world just for this day, how will she go through with this. They are real heartless people that work at these consulates. I feel they are prejudice as well because my wife wears a head scarf because of our religious beliefs.

Is there any actions I can do, I will definately call and complain and write a good cover letter for when we send in the medical report saying some of this stuff. I want to threaten them with a law suit and yell at them but I don't know if that will help or hurt our case. I am such a calm guy but this is what it took for me to get my first K3 visa even... they pulled this same thing!

Why don't they spend some of our tax money to actually do something for our citizens once instead of killing people. What the hell is there problem, they must be so arrogant and mean spirited people, most of them at least not all of course.

Visa in Hand: 11/12/09

POE: 01/30/10 (!!!!) at JFK Airport in NYC... can't wait!

Got the green card maybe 8 weeks after 01/30/10...

Medical records does expire. Just do what they request if possible. Why didnt you ignore the K-3 and just followed through with the CR1?

The CR1 was approved and we got the interview date a few days after we got the k3 visa. I found a thread called "Medical for CR1 and K3". There they said most people did not have a problem using the Medical from the K3 for CR1... unfortunately no details, can anyone please enlighten us. Thanks.

My wife just spoke with the hospital, these bastards said that she has to take the X-ray, even if she is pregnant!!!!!!!!!!! They say the U.S. embassy won't except the report without this?! What abunch of SOB's, I tell you these people doing the visas are just so stupid and insensitive... Can someone provide help on this.
