Timeline

We were married before the 90 day K1 visa expired , the marriage was 30 days ago , we are late in filing for AOS only by a month or so .

I understand there is a extra form for this situation at a cost of $355 to the government .

Anyone ?

Any ideas ?

I don't know of any extra form for this situation. Where did you get that information? Where did you come up with the $355. amount?

$355 matches the filing fee for the I-130. As a K1 adjuster you shouldn't need this form, don't know if that is the one you are talking about.

You are fine - just file your AOS SOON and you are good to go! No need for extra form, no need for extra fee - it's expensive enough as it is!

You are fine - just file your AOS SOON and you are good to go! No need for extra form, no need for extra fee - it's expensive enough as it is!

I see no reason for there to be any special forms just because you're filing late. People do it all the time. What specifically is this "website" telling you? What is this form they say you need?

I hope you're really not "too busy". This is an important process, and should be done right from beginning to end. It should be a high priority. There are a lot of scams out there under the guise of "easy immigration". Unfortunately there is no easy and you have to educate yourself.

If you just got married a month ago, and it was within the 90 day period, you're fine - just file the AOS.

05 Oct 2010 - received interview letter!!!!

08 November 2010 - scheduled for N-400 interview

- went together for interview; file isn't there - need to wait to be rescheduled

Jan 2011 - went for Infopass

25 Feb 2011 - interview

19 April 2011 - Infopass

8 July 2011 - HE'S FINALLY A CITIZEN - WOO HOOOOOO!!!!!!!!!!!!!!!

No extra form (you're referring to the I-130 - if you had not gotten married within the first 90 days/before the I-94 expired, you would use this form and pay it's fee). You're fine.

Too busy working and another project taking up my time .

Yes , of course it is very important , I am not planning on just doing nothing .

I'm considering on hiring a company that specializes only this kind of work in the hopes of getting it right quickly and to give me more free time .

Didn't I file a I 130 for the K1 visa , if so , wonder if I can just copy and use it for this ?

If you're really too busy (distracted, intimidated, disorganized, or anything else), look it over, write to them, and see what they say.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I dont recommend using lawyers because I think unless you have a complicated case, anyone is able to do it themselves.

However, if you dont have the time to read the links, stop looking for shortcuts and do this properly, I wouldn't bother.

You filed an I-129F.

So no, you cant copy it.

10/20/2009 - AOS approved, GC card production ordered! (53 days in total)

10/26/2009 - Green Card received - nearly 11 months to the day of our K1 NOA 1!

11/25/2009 - Started my new job!

02/26/2010 - Passed my driving test :-p

07/20/2011 - Eligible to remove conditions

2012 - Going for citizenship

09/20/2011 - Removal of conditions submitted to VSC....here we go...again!

It's been a quick and relatively painless journey thanks to tireless research, dumb luck and this community :)

DONE with USCIS for a while :)
