Hi,

I am getting together items for the K-1 visa. My fiance got his passport about a year ago, and has several duplicates of the photo that was used to get his passport. He hasn't changed his apperance, so I was wondering if anyone knew if there were any specifications on the date the photo was taked. I would love to be able to use the duplicates if possible so we don't have to deal with him making an appointment, getting the photos, time for mailing them to me, etc.

If the photo doesn't have a date, and he looks THE SAME WAY he did when he took the pictures, I don't see a problem with it.

K-1 TIMELINE:

05-11-2009: NOA1

05-20-2009: called the Military Help Line and requested for expedite

06-04-2009: NOA2

06-14-2009: NVC letter received in the mail

07-02-2009: Packet 4 received

08-27-2009: Interview - Visa approved!

09-03-2009: visa in hands.

09-20-2009: POE - Miami

09-21-2009: we got married!

AOS TIMELINE:

05-12-2010: NOA1

06-08-2010: Case transferred to CSC

06-21-2010: Biometrics

The instructions for the I-129F say the photo should be taken within 30 days of the time you file the petition. Have him get some fresh photos. I don't know what you have to go through in Canada, but in the US you can get passport pictures taken just about anywhere. I got mine in 5 minutes at a UPS store - no appointment necessary.

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

One thing to consider: if you're submitting copies of your fiance's passport (to present entry/exit stamps establishing your in-person meeting, for example), and you submit the same photo as the one on the passport, they're going to know it wasn't taken within 30 days of the petition.

Aside from that, I'm with Mrs Disney: if he still looks the same, no reason not to use it. Heck, I think Gary has said that Alla used the same photo all the way through I-129F, consulate, and AOS without any problems.

Improved USCIS Form G-325A (Biographic Information)

Form field input font changed to allow entry of dates in the specified format and to provide more space for addresses and employment history. This is the 6/12/09 version of the form; the current version is 8/8/11, but previous versions are accepted per the USCIS forms page.

Yeah, that is something to consider lol. Well, I taked to him a little more about it and I guess he got some photos to use for his passport, but he made a trip to Winnipeg and decided to go to the consulate, so he ended up getting different ones for his passport. So, those would work.

I dunno though.. he is worried about getting caught up on a technicality.. which wouldn't be ideal..

Well, Canadian passport photos are not the same size as U.S. passport photos (they request U.S. passport size photos). I have read that sometimes the consulate lets that slide - I don't know if USCIS lets it slide when submitting the I-130.
