Hi, everybody!

Another newbie here, I hope you can help me clarify something.

I got petition approved for both of my parents and just paid my AOS fee.

I haven't been working for a while (taking care of my children) so my husband will fill out I 864A. However we still don't meet income requirements. I have real estate in my country of origin and my parents have a lot of property there so we plan to use it as the assets. So here come my questions:

1)Do I just write $0 on question 23.? Does NVC need any explanation from me why I don't have any income?

2) My husbands income decreased over the past three years (moved from different state and got laid off), is it really bad? He might make a little bit more now than last year but we haven't filed our taxes yet...

3) Does my husband need to provide pay stubs and employment verification in addition to tax returns?

4) My parent are getting my apartment and one of their houses appraised, together it will compensate for whatever amount we need to qualify:

a. can they fax all the paperwork (title, appraisal etc.) over so I can submit it asap or do I have to have the originals?

b. If copies will do, do they have to be notarized?

c. Do I write down all of their assets or only those that are enough to qualify?

5) My husband changed his name's spelling during naturalization, does he have to enclose court order with our tax returns since his name is slightly different now?

If you did not have any income then yes you would put $0.00

You need to file those taxes.. NVC is going to be looking for tax information for the last tax year

Yes he will need to get a letter from his employer stating how long he has worked there, how much he earns and if his employment is likely to continue. He will also need current paystubs

NVC normally need to see the originals, but as you will need to file taxes for 2009 you will have time to get the originals sent to you.

You can list any or all the assets you have but you will need a appraisal for each asset you use.

Has he updated his name with the SSA? If not he should do that ASAP. If you are mailing your tax return then you could include a copy of the court record. If you are e-filing it then as long as he has updated his SSA records the IRS should not need to see the papers.

We did file for 2009(in April), what I mean is we haven't got W-2 for whatever he earns now, so I suppose we can just estimate his income based on his employment verification letter and write it down?

Would it be accepted as the current income?

So basically my parents won't have any papers for their property over there because they will send it all here. Will they get it back before the interview?

It's just confusing, instructions for filing I 864 don't specify that it has to be an original it just says that I need to show the proof of ownership and appraisal.

Yes, he did, but we filed for taxes before he was naturalized (a month before)
