LinaJ-Hmmm....looks like I'm not the only one with the $595 NOA....You could be right there in saying that "it's just their way of doing things". Lol...as long as they don't come back and ask us to give them the extra $80 that we already sent them, and cause any further problems/delays because of it, then we should be ok there....

Now I wonder if the biometrics letter itself is the extra "$80 reciept" instead...hmm......

Ant

Hello All,

I have made photocopies of every check I have ever sent to the USCIS. It became very important during the AOS portion of the process. Here is what happened: As all K-1's know, part of the documentation that USCIS requires to file the I-485 application for AOS is the NOA 2 (approval notice from the I-129f fiance visa application). Well, I never got one! I thought for sure I would be RFE'd for that and was very concerned I would never get my green card so I filed a form I-824, Application for Action on an Approved Application or Petition, which is basically a form requesting a copy of a form that the USCIS never sent to me, and carried a $200 filing fee at that time! Unbelievable that they have a form of this type. Well after 4 months I got a letter from USCIS stating that they could not send me a copy of the approval notice because I had not sent the proper fees for the I-824! I was very upset. So I made an Infopass appointment at the local office here, showed the officer the photocopy of the check for $200. She immediately had me hand write a letter to the USCIS explaining the whole experience and enclosed a copy of the copied check. She actually followed me to the mail box and watched me put the letter in. At this point I had already mailed the I-485 application and thought for sure I was going to get an RFE. Well, I did, but not for the missing NOA2 approval notice. It was for two items that I had included when I mailed the application. A birth certificate and something else (I forget now) that of course would have been included with the submission. About two weeks after mailing the letter with the photocopy to USCIS I rececived not one, but two copies of the approval notice. Unbelievable. Surely the right hand doesn't know what the left had is doing. Sorry about the long rambling post. Hopefully this will help somebody else. I guess the moral of the story is to always copy everything you send to USCIS and everything that they send to you! Thanks for listening.

Peace, Evan and Meaw

Hi Everyone,

Just to update and let all you VJers know that....

The neighbour's pet rooster crowing extra loud very early this morning and my baby's crying woke me up this morning, yet again, and I couldn't back to sleep. But for some weird reason, insead of attempting to go back to sleep or going to feed the baby right away, like I usually do, instead, I decided that I should check my e-mail first.

So I checked my e-mail this morning, only to find an e-mail from the USCIS which said:

Case Status Information for Receipt Number: NBC*XXXXXXXXX

Wednesday, September 23, 2009 5:00 AM

From: "USCIS" <USCIS-CaseStatus@dhs.gov>

To: (my e-mail address here)

Receipt Number: NBC*XXXXXXXXX

Application Type: N400 , APPLICATION FOR NATURALIZATION

Current Status: Request for Additional Evidence Sent

On September 22, 2009, we mailed a notice requesting additional evidence or information in this case N400 APPLICATION FOR NATURALIZATION. Please follow the instructions on the notice to submit the requested information. This case will be in suspense until we receive the evidence or the opportunity to submit it expires. Once we receive the requested evidence or information and make a decision on the case, you will be notified by mail. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

If you have questions or concerns about your application or the case status results listed above, or if you have not received a decision from USCIS within the current processing time listed*, please contact USCIS Customer Service at (800) 375-5283.

*Current processing times can be found on the USCIS website at www.uscis.gov under Check My Case Status and Check Processing Times.

*** Please do not respond to this e-mail message.

Sincerely,

The U.S. Citizenship and Immigration Services (USCIS)

An RFE? Huh? I thought that I had sent them enough evidence already (surely 100+ pages is more than enough, right?).

So I logged on and checked on CRIS, just to make sure that this e-mail was not a hoax, and found the same message there too, which said:

Request for Evidence

On September 22, 2009, we mailed a notice requesting additional evidence or information in this case N400 APPLICATION FOR NATURALIZATION. Please follow the instructions on the notice to submit the requested information. This case will be in suspense until we receive the evidence or the opportunity to submit it expires. Once we receive the requested evidence or information and make a decision on the case, you will be notified by mail. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

A request for evidence is made when an application/petition is lacking required documentation/evidence (initial evidence) or the officer needs more documentation/evidence (additional evidence) to determine an applicant's eligibility for the benefit sought. We may send you a request for evidence at any stage of our review. The request will indicate what evidence or information is needed for us to fully evaluate your application or petition. The notice will explain where to send the evidence and will give the deadline for your response. Your application or petition will be held in suspense during that time. If you receive a request for evidence and have questions about what you need to submit, you may call our National Customer Service Center at 1-800-375-5283.

Again I wondered what was going on there....An RFE, what the heck?

But then I remembered what some other vjers have mentioned about RFEs being Biometrics letters instead...So I thought to myself:

"I wonder if this means that I will get the biometrics letter in the mail soon? If that is the case, then this 'RFE' is a good thing!"

Hopefully this indeed is the biometrics letter...and not an actual rfe...What more would they want otherwise?

For those of you who checked your case status for your N-400 on CRIS and got CRIS e-mail updates, did it look something like this too?

Lol..Seriously, the USCIS should consider having separate e-mails for biometrics purposes. Why send notice of an RFE (and worry a lot of people in the process too) when they are not getting RFEs but in fact are getting something else instead?

So now I wait for my mail again and plan another trip to the mile-away mailbox...Wondering about this "Mysterous RFE..."

Oh well, at least the USCIS "touched" my file, so that's ok, right?

"RFE or Biometrics?"...That is the question....!!!

Any other thoughts, ideas, suggestions, humour, jokes, appreciated too....

Hi Everyone,

Sherose-Sorry that you had a bad experience with the USCIS before too. I can't believe tha they had the nerve to charge you for such a mistake, either, even though it wasn't your fault for their errors. And after such a error was corrected, why didn't they give you back a refund? Either way, glad that you got sorted out and you have your green card (and on your way to citizenship) now and don't have to worry about that anymore. Still, it doesn't make what they did right, and hopefully, like you said, this will help others too (perhaps you can post this in another vj forum, to warn others as well). I agree, make a copy of everything one sends to the USCIS...just in case...better safe than sorry....the right hand and the left hand...yup...have to keep them in line and correct, indeed.

Hello All,

I have made photocopies of every check I have ever sent to the USCIS. It became very important during the AOS portion of the process. Waiting2008-Likewise, I got the same e-mail this morning too (see my previous post about that). Congrats about getting your "rfe" (umm.."biometrics e-mail", I mean). Hopefully this is a biometrics and not an rfe for the both of us too!

Hey guys,

Gsmaclean-Thanks for adding your info to the list! Welcome to the N-400 September 2009 applicants message thread! Nice to meet another fellow Canadian (from Toronto) like me too and live so close to each other (OH is not far from NYS)! Odd though, that you from OH would file in Arizona instead of Texas.

Wow, what a co-incidence as well, that we have similar immigration timelines overall. By the way, are you planning on being a dual Canadian/American too?

Good luck on the rest of your immigration journey too. Keep up the updates here.

Adding myself to the list...hello to everyone I haven't seen for a while!

Maryces21-Ah ha, now I remember your past post from the I-751 boards! You were the one that said that they gave you the wrong code (code 1, instead of code 3, I think) for your I-751 case. Doesn't same fair that they would delay and wrongfully deny your case and waste your time going to Jacksonville just because of their error. Glad that you got that sorted out though and now don't have to worry about that anymore..And yes, they should give you back your money (or not charge you for the N-400) because of their error (sigh..wishful thinking though..they don't give refunds). Hmm...though this got me thinking as to possibly why they put $675 instead of $595 on your NOA...They know that they messed up on their part for you before and they probably know you can appeal not charging for fingerprints again...so to protect themselves, they can say that they cashed your check in for biometrics and you can't get away with not doing biometrics again this time around...just a theory....not fact...but who knows....

By the way, for the N-400, I've read here on VJ that it's a different code this time around (code 1, I think, no photos...)...But yes, do check for the correct code this time just in case...you don't want another error here!

Guys;

I also want to let you know that they retook my fingerprints on 04/09 for I 751. Probably they just cashed the check but because i have a recent fingerprints they will return my money!@!!!!!!!!!!! Iam joking I do not expect any money back but probably they just have to cashed my check and that it is. I will tell you how many fingers they are going to fingerprint. Since they did it wrong the first time. (They did not fingerprint my ten fingers just my index). Then a year later I received a later saying that they did not have my fingerprints on file, my case was denied , and my residents priviliges cancelled. ....blablablablabla. After two weeks calling everyone and going twice to JAcksonville. they fixed and they sent me a new green card.

Guys;

Yes that is me!!!!!! Now it is funny, but then it was really painful and frustrating. I double check my appoinment letter and I did not see any code on it. Let me know when you get yours. Since it is on its way. I am sure you will not get a RFE.

Yes to that  no one really knows when they have this so much energy to make notice earlier and send them right away to recipient. I got the so-called "asking more evidence" email before i got my biometrics .... so I am guessing that made it delayed my biometrics schedule.

Hi Everyone,

Maryces21-Lol...I bet it wasn't funny at the time...but when you look at it now...seems kind of funny..Anyways, no need to worry about that anymore. Odd though, that there is no code on your N-400 biometrics letter. Hopefully they don't make any mistakes, despite that. Will definitely let you and everyone else know what code I get when I get my "RFE/Biometrics" letter too....

Jovana-Danijel-Welcome to the September 2009 N-400 message thread! Is it ok that I add your information to the list too (based on what you said on your vj timeline). Thanks in advance. By the way, what a co-incidence too, that we filed on the same day, and got the noa on the same day, and got this 'rfe/biometics' on the same day too. Likewise, I got the same notice as you did (see above posts for exact notice)...and am wondering...Is it biometrics or an actual rfe? Hope it's biometrics and not an rfe in your case too. As for the reciept number...Perhaps they are doing an upgrade on their system now, so if it doesn't work now, keep on trying again later on....Oh and when you enter your case..Do this: NBC*(followed by the rest of the nine numbers of your case)...Hope this helps too.
