Adjustment of Status confusion

Hi everyone

I am a UK citizen and entered the US on the 12th August on a K1 I got married on the 22nd August :dance: and now am filing for Adjustment of Status. We used a lawyer for the K1 but cant afford it for this part I have tried calling the USCIS who are as far as I can tell useless, they cant even tell you what to write on a form! I want to know what my Alien Registration Number means and entitles me to, on the back of my I-94 it has my A# and is stamped "EMPLOYMENT AUTHORISED" and dated on the day of my entry.

Can I get a job or do I still have to file I-765? Do I still need to get a Social Security Number? If so when?

Can anyone help? AAArrrgggh!!

The USCIS isn't going to help you fill out forms.

I believe you are Employment Authorized while the K1 is valid (before you marry) - you're married now, so you can't work, because you are technically "out of status". You'll have to file for EAD.

I think you can just go to the Social Security office and apply for you SSN - and yes you do need it.

Your A# entitles you to nothing - it's just a number they have associated with you.

First - no, you can no get a job without first filing the I-765 which will get you the EAD (Employment Authorization Document/Card).

Secondly - the AOS stage is a pretty straightforward process - especially for a K-1 entrant - that being said, there are some really good guides here on VJ that you can use for pretty much every step.

A great help in knowing what to do and when is the K-1 Visa Flowchart , you're on Step 18. The Step-by-Step Guide on How to File for Adjustment of Status for K1 and K3 Visa Holders

fills in all the details and the Example Forms Section will help you figure out what to write in most all the forms.

For social security card - Step-by-Step Guide to getting a Social Security Number (SSN) section will be of great use to you.

Thank you!!!!! That was sooo helpful!! I was actually in a SS office today as my wife was changing her name and the girl there told me I couldnt get a card/number until after my EAD came through!! Going to go back and wait again tomorrow!!! Thanks again! I should have known I could have relied on a German for concise helpful information you should get a job at the USCIS!!!!!! You answered what four poeople from 3 different agencies couldnt answer!!! :star:

By the way Print This and take it with you to the SSA (just in case you need to quote their own rules to them - if you get a negative answer, ask to speak to a supervisor).
