Ok, I don't think I am within the normal timeframe and seems like the AO is deliberately holding my case un-necessarily. Been more than 44 days since my AOS interview and despite my repeated calls to USCIS and an infopass, no credible info has been provided for the delay in decision. The interview had gone well so the AO was in position to decide on the spot. Now my question to mt friends is that how do I approach a congressman. And how can he be of any help to me? Do i write to him, visit his office and how is he/she going to contact the USCIS on my behalf? Anybody has any experience?

First thing to do is request or go to their website and print out their "release of information' form - this would give USCIS permission to release information about you/your-case to them.

Most people call their office - unless its convenient to make an appointment in person.

I'm not sure 44 days constitutes reason for alarm. I would at least wait 90 days. Besides, you are here now and now waiting to come here so the wait shouldn't be that difficult.

Your elected representative will most likely tell you something similiar. Most congressmen and senators have staff specifically to address immigration issues and most are very responsive.

I faxed a letter with the release of info form to my congressman's office.

Simply, I wrote our situation and asked for them to make a formal inquiry. The letter doesnt have to be elaborate,include your case#,your contact info and ask them to make a formal inquiry into your case. Tell them the steps you have taken to get answers and ask that they help you.

Some reps are fantastic, other suck....we were lucky

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

i have this form as you are from new york.use this form also write down a whole information of you case with case number in piece of paper and give to them.

I don't really have anything useful to add, but I just have to say if I was you I'd be asking the exact same questions. I'm not a patient waiter, and in the case of something like this...well...you know!

90 days is the usual cutoff time for determination of benefits (from what I have seen)

I think go to senator right now. i don't think as you go over there they will start working on your case. because they will give you also some witing period. so i think you should go right now and after giving them a case anyway you have to wait from both side.i saw lots of people get approval same day of interview and still you wait for 45 days.

There is nothing wrong with advocating for yourself. If its been 45 days and you want to ask for an inquiry...ask for one! It doesnt harm a thing to have a rep do an inquiry for you. :)

With our case, I knew that our congressman wouldnt speed anything up drastically, but i wanted answers and to be able to know what was going on. The peace of mind you might get from writing him/her(if they are helpful and useful) is worth a shot IMHO and experience

'Y's_habibitk': Thank you for endorsing my point. So should I approach a Congressman or a Senator on this issue. Also, since I am the applicant who doesn't have a status yet, Should the application be filed by my wife(The USC) or me? Is this what's called A CONGRESSIONAL INQUIRY?
