Dear all,

I was waiting for the divorce decree to start the K1 procedure.

I went to the court on August 4 and received a paperwork that really looks like the divorce decree but I was told I would receive the official paperwork later.

My question is: is the document I received sufficient as a divorce decree for an immigrant applying for a K-1 Visa?

It says:

The Court pronounced the divorce of:

xxx (name of ex-husband), born (date), living at (address)

and

xxx (me), born (date), living at (address)

who were married in (city) on (date)

+ signature of the judge and 2 people working at the court.

I want to translate this document (by an official translator) and send the package now to the Immigration (everything is ready, I was only waiting of the divorce decree) to start the procedure as soon as possible. Do you think it is a good idea to try, even if they come back with a question OR is it better to wait until the "official decree" which will probably be exactly the same document?

Thanks for your advice, always greatly appreciated!

No. It MUST be the official. filed and stamped document, and it must be translated if it is not in English. You will send a COPY of the official divorce decree along with an ORIGINAL signed and certified translation. IF the document you have is an exact copy of what the official document will be, you could have a translator get started on it.

You definitely need to wait until you have the final divorce decree document or the USCIS will reject your petition. Also, you only need to send copies of everything to them, not necessarily the original documents. This goes for everything, birth certificates, divorce decrees, translations, etc. Only copies are needed.

OK... thanks for your help. It just makes me sick to wait 2.5 months for one sheet of paper which will very likely be exactly the same that the one I just received by mail... But if you think I could be REJECTED for that I will trust you. I thought that they could start to handle the file in the meantime and that I could send the very official divorce decree as soon as received if they need it.

The problem is you would NOT be rejected. That would be the quick and painless way as they send the whole thing back, you correct it and re-submit. You would likely get an RFE which could easily add 2-1/2 months in itself. Is there some way to get the document faster? Go to the court clerk and ask for a copy? I don't know, seems a very long time to wait to get a stamp on a document. I KNOW how it would be handled in Ukraine, but not sure about Belgium.

I found a way to go faster: bothering people and calling them every day until I get this paperwork  It works !!! I hope to have everything ready for October 1st and this will help us to save 1.5 months! So to those who are waiting for administration stuff: CALL CALL CALL even if they will hate you. At least they want to get rid of you and will handle your request.
