Timeline

After having our I129 returned to uscis at the interview, I am now preparing to fly to Jordan to marry my fiance and I have lots of questions.

1.Do I need to cancel the I129 or let it expire (Sept 22)?

2. Can he apply for a visitor visa to come here while we wait once we are married? I know its hard with the K1. But what about with this?

3. I am also undecided on the CR1 or K3. Do I file the I130 regardless of which visa we actually choose?

4. We can decide CR1 or K3 after uscis approves the I130?

I feel so lost. This is the last thing we expected... especially on the grounds of lack of proof of a relationship. And thats amazing to me when he had copies of over 6000 text messages from me from the last year, phone calls every day (and I don't mean 2 minute calls), chats, emails, everything.

After looking at our pics, the CO decided I was too old for him and NEVER looked at any proof of our relationship.

So we want to marry as we had planned... only now in Jordan not the US. And I need good advice.

Call the USCIS and explain what you want to do, they should let you know whether it's best to cancel the I-129F right then and there or if you should let it expire.

Your spouse can apply for a tourist visa if he wants to come see you while they're processing his petition but in my opinion it's a guaranteed denial based on his K1 being denied. But, you never know.

Yes, you have to file form I-130 for either the CR1 or K3. The K3 needs another I-129F along with the I-130. (See the Guides).

It's best to decide which visa to follow when you file. Many people send both, the I-129F and I-130 for the K3 and after seeing that they were both approved at the same time, just go along with the I-130 and leave the I-129F on the side so they can get a CR1 instead of a K3. My advice is to ask questions and do more homework regarding both visas for people going through Jordan. Each embassy is different but most process both in more or less the same amount of time but it's best to ask around and check similar timelines before you decide.

The chances of a young muslim arab getting a visitor visa are slim to none unless he is very weathly.

Yes, both the CR1 and k3 require a 130

If you file for a k3, you will want to send in the 129f as soon as you get the NOA1 for the 130, you cant wait until you get an approval on the 130

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

1. Cancel the petition by sending a letter to USCIS

2. HE can apply, no guarentee that it will be approved. With a denied K-1 and a marriage to a USC, it may be a hard sell

3. Go for the CR-1. When I applied, stand alone I-130's where being approved 4-6 weeks faster than I-130 and I-129F filed together.

4. Yes but typically they are approving them both on the same day. Save yourself some time, go for the CR-1.

You will still have to overcome the resons for the K-1 denial. While you can't change your age difference, you can change the proofs of a bonafide relationship. Start with primary evidence, boarding passes, hotel receipts, passport stamps, maybe include affidavits from friends or family to attest to the validity of your relationship. And be VERY picky about what you send to USCIS

Best to send a notarized letter canceling the K1.

Main thing is getting married won't change why you were denied. Age gap can't be changed. My suggestion would be to "front load" the I-130.

Yes you can submit the I-130 alone and decide after the NOA1 about the K3. CR-1 is MUCH better.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

excellent suggestion! The CO sees the copy of the submitted 130 before they even interview your husband, they can see all of the evidence upfront. Look at all of the pics you submitted and really critique them...send the best ones, where you both look happy and in love and again, pics with his parents will be seen as a huge plus
