K3 vs IR1

Hi everybody..

Today my wife received in her email the packet 3 for the K3 visa..

My question is the following.. Since I got approved for both I130 and I129F at the same time, is it worth to go on with the K3, or it is better to wait for the IR1?

Another big question, does anyone knows if there is an expiration date for the forms to be sent out?

And still..... If I go on with the K3, what's going to happen next with the IR1? I will just have to have my docs in the US with me?

The K 3 will result in more expense later. The need to apply for & wait for an EAD to work. A year of agony while doing the AOS & the expense of the AOS.

If you come on a K 3 your docs for the I R 1 will remain at USCIS until you file for the AOS. The fee is 1,010.00 I think.

The I R 1 is much better in every way.

Hey Freddy2081,

As far as I know K3 is the fastest route for your loved one to get into USA. Although IR1, you enter the US with a green card, I think the process is slightly longer, not sure though. I myself, will be going via the K3 route. The first visa to get approved will be carried forward; the other will be dropped by USCIS. If both are approved at the same time, then, I think it's your call which to continue with. I don't know the expiration date, it's either 30 days or 60 days. If I was you, you'd get it filled out ASAP and sent out ASAP, don't delay. For all the documents, put them in folder and have them with you. If you decide to go with the K3 route, you will need your medical exam and other paper work, when you apply for AOS (Adjustment of Status). The present cost of obtaining a green card I believe is $1,001.00.

The I-130 has to go through NVC while the K-3 speeds through NVC and on to the embassy. You may lose 4 weeks or so if you go for the Ir1 but it is the superior route to the US - immediate green card, work and travel authorized, no further expense.

If I go there I will need to work right away, because my wife is pregnant, and we can't wait too long for me to get a job..

The IR1 will take aroung a month to be completed then... The K3 will be like what? a couple of weeks?

The approval came Aug 18th... i guess the NVC is on the way to assign me a case number, right?

K3 is dog poop compared to the IR-1. Get a 10 year GC without having the cost and hassels to do AOS and removing conditions.

NO comparison whatsoever.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

You see, i missunderstood the NVC guide... I thought i need another number in order to call NVC, instead I just need my USCIS receipt number (NOA1)

Knowing about all this stuff before filing the petition, would have saved us a lot of time....

I personally would stick with the K3 visa. Get your loved one in the country and then apply for your AOS and Green Card. It may cost you $1010.00 more, but honestly, money is money. Being with your loved one ASAP, is much more important. You have 2 years to apply for the Green Card.

you have been married over 2 years, definitely do the ir1, it equals a 10 year green card with no conditions. saves u a lot of money in the end. plus no uscis for 10 years, unless you apply for citizenship :thumbs:

I totally understand what are you saying, plus we have a son together and its really hard for tha whole 3 of us...

Im the beneficiary, and my wife is the petitioner, she has been here (in Italy) until august 14th, she waited here for that reason, so now watiting a couple of weeks more, but enter the us with all the benefits of a permanent resident i think is better.. Not because of the money, we spent plenty of money with plane tickets and stuff, but for the working situation, because she is the citizen, and she cant find a job because she is pregnant... So I will be the one to provide for everything, and going there without a working permit will mean living under a bridge °_°

Yes, we have been married for 4 years, so I should get directly the green card... and after the famous 3 years Ill be able to apply for citizenship...
