Does anyone know of a good immigration lawyer in Atlanta, Georgia? The Embassy I am dealing with is New Delhi if that matters.

The forms you need to complete are pretty straightforward and then there is VJ if you have any questions. My suggestion is to do this yourself and save the money you would spend on an attorney for your honeymoon! You really do not need the services of an attorney for this. IMHO, of course. :thumbs:

Not to contradict, but before we say you do not need an attorney, is there an oddity that may justify it. If this is a straightforward case, then definately do it yourself with the help of all our experiences...On the other hand, if it is a difficult case that would involve an increased risk or denial you may want to get an attorney. Basically, if this is a legitamate relationship, you have evidence that you two are sincere with intent to marry, have met in the past two years, and dont have legal / criminal / or immigration issues already, I would go at it yourself. The others may be a flag you want professional help with.

3/11/06 - 3/26/06 Visited my baby in the PI's

3/29/06 - K1 packet recieved at NSC

6/01/06 - Redirected to CSC

6/14/06 - CSC e-mailed confirmation on the reciept of file

6/23/06 - They they sent the IMBRA RFE

7/03/06 - The emailed that the IMBRA RFE went out on 6/23/06

7/03/06 - I received IMBRA RFE

7/05/06 - Touched

7/06/06 - Delivery Confirmation from the Post Office RFE recieved

7/11/06 - Email notification from CSC that IMBRA RFE Recieved

7/12/06 - Touched (but was to respond to an email that only said 'request recieved and will be processed within 30 days. argh)

7/13/06 - Touched

NOA2 September 11!!!

10/18/06 - Received at Embassy

12/23/06 - Recieved package with interview/medical schedule

01/08/06 - CFO interview/(pre-departure class) Complete

1/11/07 & 1/12/07 Medical complete

02/05/07 - Interview!!!

2/7/07 (2/8/07 manila) - Informed we are approved...3 days after interview.

As meauxna points out, sakurasama did not say anything about wanting to retain the services of an attorney. Beyond that, sakurasama provided precious little information about his case - how could you possibly have a valid basis for what she needs or doesn't need?

One thing we do know is that there's a Chinese (Tibetan) national involved who will be applying for a visa in New Delhi, India. I can understand why sakurasama might want to have a talk with an attorney.

[EDIT: Oh, and we also know that surakasama wants to get married, or at least have a wedding ceremony, in India this fall. Another reason why consulting with an immigration attorney on points of immigration law would be a smart thing to do if thinking of a K1 visa.]

My fiance and I met in April 2004 in Dharamsala India. He is a Tibetan refugee. I spent a year there as a volunteer teaching English. In April 2005 we started our fiance visa process. Everything was going well. He had his interview in August and they requested a financial cosponsor since in tax year 2004 I had no income as I was volunteering and meeting my fiance! The phone connections to India are pretty unreliable and they don't answer their email; I was trying to contact them to ask them what were my other other besides a cosponsor (I am 37 years old!) They finally emailed me and told me that I could use my 2005 tax return instead of a 2004 and when we submitted all our paperwork we were told our petition had expired and the consular officer decided not to grant an extension because she/he was "not convinced of the relationship". (I am not really clear why this is- we do have a bona fide relationship and furnished photos, correspondence, train tickets with our application). So our petition was sent back to the U.S. where for some reason the transit time from the Embassy was so exceptionally long that it just arrived at the California Service Center this month. I need to figure out whether I can recesitate my petition or what to do next.

So anyone who starts feeling sorry for themselves about IMBRA or their few extra months wait, think of me. My fiance visa has hit almost every roadblock imaginable and is going on 15 months! I didn't think I needed a lawyer in the beginning because it all seemed pretty clear cut- I love him, he loves me, let's get married but now I know I need a lawyer!!!!

First, I understand what you are going through, been there doing that.

The Consulate Officer is just doing his/her job. I am way past the angry stage being a year later. You are bait for an Attorney to sweep in and say: Your Fiancée is gone forever! In addition, for about 6-10 thousand dollars, I will help you. Yeah and the sun will not shine tomorrow… nevertheless.

When a Consulate Officer denies a K-129F petition, this is what will happen.

You will receive a form letter “unsigned” from the Consulate in Washington DC from the Country where your fiancée lives. It will probably say: After a careful review, pursuant to 9 FAM 42.43 N2.2 that a reasonable person would be convinced, a sham relationship, to evade immigration laws. bla bla.. This will arrive in about 40 days.

Then in about 7 months later you will receive from the service center that approve you petition 2 letters, One from the Consulate which is a written report to the specific reason(s) why they (the consulate officer) decided to revoke your petition. The second letter is from the service center whom approved your petition which now reads; SERVICE MOTION TO REOPEN WITH INTENT TO DENY here you will have a chance to rebut the consulate officers findings (In fairness to you)

Then 2 months later (if you are successful) you will receive from the same service center that approved your petition initially a letter of DECISION that states; After review of the record, including any response you have sent to this office, the approval of the petition is reaffirmed and the petition will be forwarded to the Consulate/Embassy who denied your petition.

Hope this gives you an idea of what is before you. This is what I’m going through now and I found no information on the web as to what the “procedures” are, to a petition the is revoked with intent to deny by a consulate officer.

I feel if you do not challenge the consulate officers findings, that decision will haunt any new K-129 or even the 130 petitions should you marry and think… this will work… Nope, The Consulate Officer has all the reason to deny you once again. Think about it… I did and went this way.

However, this is my decision and my avenue to follow.

Oh, I am still waiting for a new interview day for my fiancée. Should happen in the next few months. If you really love him/her this is nothing but time. Keep busy and stay healthy because I love you and soon we will be together. I say this daily to her. =-)

Okay, I stand corrected. However, on the surface, with no additional descriptive information, it is most simple to complete the forms yourself and save the money. Had Sakurasama provided further clarification then of course, I would have agreed that they consultwith an attorney. Be it known that I have seen so many people spend three thousand and more dollars for an attorney who do nothing more than act as a "mail drop" for their clients. The clients must still complete the forms, or at least provide all of the requested information to the attorney for him/her to complete, so what good is the attorney at that point? Given extenuating circumstances such as is apparently present, then the advice of a good attorney may well be prudent. That is all. Jeepers....all this for my opinion....golly! :wacko:

Any ideas how to "prove" a real relationship? I was going to send about a hundred photos of my fiance and I together, a few hundred emails, pages and pages of love letters, and letters from our friends and family attesting to the veracity of our relationship. Is this what they want? I guess the best thing is to read the report that the Consular officer furnishes and rebut it point by point? I think I do have some naked pictures of my boyfriend- would that be REAL enough for them?!

What have you done or what is your plan?

This is what it all about, In the last 2 years I thought all would be fine, just follow the K-129F procedures and all would be fine… I have lost 2 of my 3 brothers waiting… thinking something got to be better… I have nothing to smile about yet knowing that someday I’ll be with my love is…try explaining this over Yahoo messenger during morning coffee. I cry for my loss each day… time without, is worse than anything I know…

You should be my misery penpal! I am on antidepressants, I periodically yell at people for no reason and my best friend is my dog because she is the only one I want to spend time with anymore. The visa process has made me crazy. And none of my friends or family members really understand what it is like.

The visa process has made me crazy. And none of my friends or family members really understand what it is like.

My dear friend,

before I ran naked in hope to convince a consulate officer ("quick! see me!!) I'd would had all my friends and co-workers sign my signiture petition of my intent to marry, all states, for a price will do a background check to show all is well and we believe she/he is single and free to marry. Very easy my friend, cost about 32 bucks thats good paper. takes a few weeks to get.
