3 yr bar and Visa interview abroad

- My husband (came with F-1 student visa with D/S in I-94 card and did school for one semester) got Volunteer departure from immigration Judge back in April 2007 for staying around 7 months of unlawful presence .

- He left on time and got three year bar.

- I became US citizen in 2009, applied for I-130 in March 2009 and recently got it approved and waiting for NVC to issue him a visa number.

- The bar is going to finish in April 2010

Now do you think its a good idea we submit DS 230 form late lets say two three months so that a embassy interview date comes after this bar ends in April 2010. This way we can avoid filling I-212 which takes about 7-9 months to approve.

Also we are having our first baby due in this September
