I'm hoping someone can answer my question. My husband and I have filed for a K3 visa. He got his NOA2 for the I129f and the I130 in February and interviewed on the K3 in April. He got put in AP and was told at the time of his interview was due to his medical not being complete at the time of the interview (they notified us 20 days prior to his interview and we didn't have time to complete the entire medicals). He was told he should contact the embassy until they give him an appointment at the 1pm designated time. I have emailed them and keep receiving the same answer that he is in AP and they will contact us once the process is complete. My question: has anyone gone through something similar and then opted to file for the CR1/IR1 and how did that work out?? We have begun the process and I just want to prepare myself for what to expect. I have read mixed messages about this process and just want some guidance. I'm mainly concerned that we will have to wait forever for an interview or that they won't even give us an interview until the AP is finished with the I129f. Thanks for your help regarding this.

ok ok!

I'm not an aficionado on AP but it seems to me that some AP is standard procedure. So even if you go for the Ir1 the AP may still be needed. You might want to post this on the AP forum for more answers.

You are in AP which means they are checking the relationship out probably. Lagos is a hard place to go through. Being in AP means you are stuck for now. Pushing another visa there won't help as it will end up in the same place. Didn't you file the Cr1 to be able to file the K3 ? See if you can contact kelly1290 or Afrilaskan Queen. They have had bump rides and may be able to provide some ideas.

This will not be over quickly. You will not enjoy this.

Thanks for the info........Just because you file a K3 doesn't mean you automatically file for the CR1/IR1 as well. You have to request the approved I130 onto the embassy, which means you adjust your status in the SO's home country. Otherwise if you interview on the I129f (which we did) the I130 stays in the states to be later processed with adustment of status once the benificiary is here in the USA. You must specifically request the I130 to go to the embassy, which is what makes it the CR1/IR1.

AP is not the problem. She has accepted the sercumstances.

But taking into consideration that she has to do the time, why not take the IR or CR1 for the better visa to enter teh US with.

So she wants to know if she can requestion USCIS forward her CR1/IR1 to the embassy. But taking that into consideration she doesn't want to mess anything up.

Exactly Missy!! Yes, it was 2 years in March. I am not trying to get out of AP at all. I know it is a common practice, especially in Nigeria so I figured if we are waiting anyway and can do the AOS over there and forego that extra step once he gets here that would be great. By going this route my husband would also be able to work much sooner and wouldn't have to wait for the EAD and he's receive his green card within a month or two. However, I do NOT want to screw anything up and have to wait an even longer time. So I'm just looking for some direction and to find out if others have done the same and how successful its been. Thanks for helping me out with the explanation of my situation Missy.

Wait, I have simular but my timelines if more current then hers, we filed too for a K3, that is in AP for 23 days now at NVC, but I'm waiting for case completion at NVC on my CR1, see my time line. Almost complete just after a little more then 2 weeks for the CR1

So are you saying since we completed the CR1 my husband will get AP in France for the CR1 interview?

K3 in AP is a random thing, also include K1's at the NVC.

On a last note, our I-129F had very little evidence of a bona fide marriage, but the I-130 had a 12 pound note book and emails, card, over 2 years of phone bills, 4 trips together, joint banking, etc. and our I-129F was passed 2 days after our I-130 petition was approved.

What stage is your I-130 at now? Could you just continue with the steps for the I-130 through NVC and on to the embassy?

Dis-regard my post, I see he is in AP at the EMBASSY . He already had his interview for the K3.

Maybe following the CR1 will mess her up, and still get AP at embassy. Have you contacted the Visa section of the state dept. and asked them over this issue??? or even a Immigration attorney? There is a site called Just Ask, Immigration attorneys there, will cost you maybe $15.00 to answer your question.
