When I lived and studied in Thailand for a year and a half, I was with my girlfriend. Then I came back to the U.S. to finish my studies, and my girlfriend came to the U.S. to work as an au pair. She was mistreated by her host family, so she came to live with me. Now, the au pair agency is saying that they will cancel her J1 visa and telling her to buy her flight ticket back to Thailand because her intent was to not do au pair, which isn't true. She wants to match with a new family, but the agency won't allow her to do that. I have many questions:

Can the au pair agency cancel her J1 visa? What exactly is the J1 visa, and could she use it to work here? If she can't do au pair, should she change her visa status?

Thank you,

Yes, the agency can cancel her J-1 visa. After that she has 7 days to leave the country.

She cannot work for anybody but the agency who got her the J-1 visa, that would not be legal.

Since the agency does not want to find her a new family, because they suspect visa fraud, she has no other option at this point as to go home.

Sorry.

Hi, there!

I was an au pair when I met my husband. I was mistreated by my host family too. They let me get a second host family and I have to move to another state. I went to spend Christmas with my husband and then he proposed to me. I married him the day after Christmas. It was so hard for us to be apart.

My LCC told me that they would cancel my visa. I dont know if that happened. My husband and I mailed my I130 and the I485 a few days my visa expired. I didnt have any problems with thanks God.

A friend who married before I did, she told me that they couldnt do that to your visa, but Im not sure. I have not working since my last job as an au pair. I got pregnant after we married and I have been a stay home mom since then.

I hope this could help you guys.
