need help about filling aos

Timeline

hi to all i just want to make sure if we really need to file the aos before the department of homeland security expired?and do we really need to file aos after we get married or we can file anytime aslong as u married already?im just curious about it.coz we not filling our aos yet..and can anybody give me all requarments of filling aos?i appreciate to any rply..thanks in advance

OCT 07-2008---complete petition has been filed
OCT 10-2008---receive NOA1
DEC 29-2008---2nd visit and wer both happy
JAN 01-2009---my baby tim proposed me and im happily engaged
JAN 15-2009---wen my baby went back home to US
MAR 11-2009---3rd visit and wer together again thanks God for the time u give us.
MAR 16-2009---he fly back to US again,i really miss him and cant handle to be far from him.

MAY 04-2009---NVC letter receive..yeeheee!!!
MAY 25-2009---medical.. PASSED!!!!

JUNE 22-2009---US entry POE Minneapolis
AUG 22-2009---MARRIED

SEPT 18-2009---AOS Sent
SEPT 28-2009---NOA1 receive
OCT 15-2009---BIOMETRICS APPT. DONE
OCT 17-2009---RFE recent tax
NOV 15-2009---EAD and AP RECEIVE in MAIL
NO INTERVIEW in my GREENCARD
DEC 10-2009---GREENCARD APPROVAL letter send
DEC 14-2009---GREENCARD APPROVAL letter on mailbox
DEC 15-2009---GREENCARD on HANDS woohoo.. thanks God

I assume you married within the 90-days your I-94 was valid for. (It's hard to tell because your timeline is pretty much EMPTY :time: not just the one in your signature...)

You should file AOS as soon as possible to protect your status - when the I-94 expires and you haven't filed AOS, your status becomes "Out of Status" - not a huge problem, but one you want to change as soon as possible - filing AOS will put you in a "Pending Status" which is better than being out of status.

The soon you file, the sooner you can begin to enjoy the benefits of being a lawful permanent resident (i.e., work, travel, drive, etc).

What is the reason for not filing?

Once the 90 days is up, she is out of status and technically overstaying. Once you file for AOS and get the NOA! for that, that document "serves" as her temporary authorization to remain.

If you wait more than 180 days to file for AOS, then this may raise a red flag with the worst case a 3 year ban for example.

I'd file quick. If I may ask, why any reason to delay? Is the cost an issue?

There is no concern if you file on day 91 or day 100 but doing so before 90 days is best and waiting a bunch of days could be bad.
