Hi,

I want to share my friend situation here in USA,, she is married but she's not happy to her husband coz her husband makes her as a slave girl ..

They dont file AOS yet , but she has a other man who loves her and want to take care of her ..

Whats gonna happen if she's going to her other man and file divorce to her husband? she dont have any documents to stay in USA coz as I said her husband doesnt file AOS yet ?

any advices there or anything , I appreciated it much ..

She will have to go back to her home country and start over with a new marriage or fiancee petition filed by the new guy.

K1: 01/15/2009 (mailed I-129F) - 06/23/2009 (visa received)

AOS: 08/08/2009 (mailed I-485, I-765, & I-131) - 10/29/2009 (received GC)

Whether she divorces or not - she has no legal status to remain in the US. Divorce is the only way to even begin another spousal/fiancé process though - at least here in the US.

This 'other man' will have to petition for her - if they try to get married (while in the US) and try to petition and adjust status while she remains in the US, there could very well be trouble (they will believe she is trying to remain in the US by marrying another US citizen, and rightfully so).

Well it's nice that her husband did not send in a AOS then.

They both tried but something went wrong now there are thing to do to correct the mistake.

First they should get the marriage annulled, that will save a lot of time and money.

Second they (husband and wife) need to talk about after marrieage is Annulled, what to do to

help her get back to her life in the Philippines.

Then her and her Newest man can see what comes of their relationship with out her having a husband.

It is so easy to find someone when all the bills are being paied by another man. She will just have to see

if the new one is worth more then the first one.

If they have not filed her AOS and it is way over due .. that is a problem no matter what.

USCIS has questioned a lot of late filers here in Omaha.

I have tried to help out a few couples but .. when they are Brought there is no hope when it comes to 1010 dollars in filing FEES.
