Problem with DS-156 K

The USC doesnt need a visa. If she is there ( here ) she wont be following you; she's in front of you. You dont need to list her.

I know she doesnt need a visa! lol. That isnt an issue. How sure are you that I neednt list her at all tho? It does say ALL children, regardless of where they are...

Because they are talking about the beneficiary, not the petitioner. You are the petitioner and therefore you do not list your children, only the beneficiary's children, in that age category.

The OP is the beneficiary, not the petitioner. The daughter is the child of the petitioner and the beneficiary, so the beneficiary will need to list her on his DS-156K as it says all children under the age of 21.

Improved USCIS Form G-325A (Biographic Information)

Form field input font changed to allow entry of dates in the specified format and to provide more space for addresses and employment history. This is the 6/12/09 version of the form; the current version is 8/8/11, but previous versions are accepted per the USCIS forms page.

I have filled in my daughter's information but wasn't sure what to put for the next 2 parts - She WILL NOT be accompanying me, because she is already a USC and living with her mother; my fiancee, and she will then obviously NOT be following me - because she's there.

Ning, i'm not going to insult your intelligence because you have pretty much taken care of that. But quit trying to twist tangents to fit your lack of understanding of the question he asked.

Its pretty SIMPLE he said "I have filled in my daughter's information but wasn't sure what to put for the next 2 parts" & "Does this mean I shouldn't list her at all?"

The next 2 parts he is asking about are the 2 YES/NO questions. GET IT nowhere does he ask if he needs to list her again as you keep trying to say.

Reread the post and then go on back in the corner and sulk and browse.

While we're at it, here's another question re DS-156: In question 36 it asks "Has anyone ever filed an immigrant visa petition on your behalf?" In my guidebook to filling this out it says to put "no." But I (the sponsor-fiancee) did file an I-129F for us, which is why I'm filling this form out.

So do I put "no" because this is a NON-immigrant visa application? Or do I put "yes" because we're in the process of this whole K-1 visa thing?

If she is your child then yes you have understood correctly and should list like you have. If she is your petitioners child by another marriage or ex of some kind then no you do not list her.

Your guidebook is correct. The beneficiary should answer "no" to this question on the DS-156 UNLESS someone else has previously filed an immigrant visa petition on his/her behalf. While the K-1 visa presumes immigrant intent, it is technically speaking a non-immigrant visa. Hence, the I-129F is not an immigrant visa petition.

The answers to those "two parts" are common sense.

I can see my answer isnt clear to you. The question is simple if you let it be. If you have children list them. Then just use common sense as to the other " two parts" . You answered your own question in the post & then question your own understanding of the same answer.

I am stunned that you think you need to list her as following you if shes not going to. That is what your post is about.

To the OP: The form is pretty clear: List all children under the age of 21. She won't be accompanying you, and she won't be following you, so tick "No" for both. If you're concerned about it, you could write "See explanation on attached sheet" on the next line and attach a sheet explaining that your child is a US citizen and already living in the US—but this probably isn't necessary. It will already be clear from question 37 on the DS-156, "Are any of the following persons in the U.S., or do they have U.S. legal permanent residence or U.S. citizenship?"

:thumbs: To bad everyone can't just say "I was wrong in my original answer", It happens to everyone once in awhile. Instead we have to watch the hole digging and squirming. It's easier for me to say "OOPS" sorry I was wrong.

The other guys on here corroborated these facts and that i was correct to do so, so the matter is simply over. Why on earth you are trying to convince us that you meant something you clearly didnt say is beyond me. No one that has read your posts agreed with that you said.

Its really immature to think you had a go at Pizzadude when he was being light hearted and was clearly correct when he stated that you were wrong!!

What an idiot. I wrote on the forms EXACTLY as I originally said - just wanted to make sure I was right in doing so. Only idiots like you give bad advice.

The other guys have just reassured me thats all. I really don't know what you problem is.

In regards to my previous post, I said please forgive me if I've misunderstood in reference to the post not the form. It was actually pointless me asking the question in hindsight as I pretty much knew it was right but wanted to make sure - then all this happened lol
