ugh i know. it was a week ago now, that i got NOA2. come on NVC!

should i speak to an operator next time?

It took nearly 2 weeks for us to make it into the NVC system. Somebody mentioned on one of the boards that the USCIS sends the petitions out in a wad on Fridays. So if you got approved late on a Friday, maybe you wouldn't be sent over until the following Friday? Probably just a rumor, but maybe not.

I'm afraid I am going to be stuck @ NVC for a while. The PCC finally came in and now we're just waiting on court & prison records. Those should be ready by the end of next week.

I suppose I'd better get used to waiting, eh, with a denial and waiver looming.... :blush: I've started gathering together evidence of hardship. I've requested reports from everybody who can support my claim. It's embarrassing to have to do so, but I really need to stay here, and I need my husband with me.

Most people are surprised at how difficult this has been for us. Everyone in my small town seems to believe that my husband should be allowed to just walk in now that he's married to me. They got used to seeing him/talking with him here while he visited. I have had to explain it many times over, and people are often really offended by the unfairness of it all. Most understand that there needs to be a process, but they generally have no idea how long that official process takes. Some, of course, joke that I shouldn't have married a "foreigner." That hurts. I've learned to brush it off, but it does still hurt.

Despite our uphill battle and ultimate denial at the interview, it will be nice to make it out of NVC - another obstacle passed.

Anyhow, that's my rant for the day. Off now to can some tomatoes from the garden. Every time I stuff a jar full and plop it into the water to process, I think to myself....maybe when I open this jar up, it will be to make a big pot of spaghetti for my darling husband.

Julie, if I may ask, if you got approved at USCIS, why would you be denied at the intervew?

hi everyone,

so i decided to go down the cr1 track after my i-130 and i-129f got approved at the same time. i just wanted to let everyone know that there may be something up with the dhl tracking site.

nvc told me that they sent out the package on sept 3 and i did not come across any package for that day or any day close to it...i got a letter in the mail that my case was forwarded to islamabad dated sept 8th on sept 11th. I checked the website again and there was a package sent on the 8th so I assumed it was me. However, my husband received the 3.5 package in the mail today. So for everyone who is neurotic and ####### as I am, the dhl website can be used only as a reference. anyway, there is no way to track that the package is actually yours...

There is No way to confirm it is your package, just a GUESS ####### shoot.

USCIS can really only approve my right to petition for my spouse. They basically review everything and say okay, you've got the paperwork to prove you're married & that you want to bring your spouse here - go ahead and jump through the rest of the hoops.

Husband has a 28-yr old crime involving moral turpitude that will require a waiver. There should be no problem with that, because it's been over 15 years and he's clearly rehabilitated, but the biggest problem we have now is that he entered the US to visit me 8 times under the VWP. They handed him that landing card on the plane and one of the questions asks if you've ever been convicted of a crime. The sentence is such a bad run-on sentence, though, that he didn't understand it, and checked "no." He thought that you only had to check "yes" if you had a sentence of over 5 years

Heck, I'm a legal assistant, used to seeing legalese, and I read the danged thing and didn't fully understand it! Regardless, the US Govt's opinion will be that he misrepresented himself 8 times. It will be a fight, and I've seen the London office deny people for much less.

Oh geez, I see what you mean. Stupid wording on the form, and Im sure you tried to get the records, and even if they are available, takes forever to get them, or the excuse of poor record keeping comes into it. Okay, now is there a way to apply for a wavier before the interview? this wavier stuff Im not educated in, but its worth a long indeepth look, especially since we are talking about your life together.

The reason I ask this is cause I think some filers included a wavier when they filed with USCIS, or atleast its the way I read it. So why not bring a wavier to interview? or Im not thinking that correctly?? I will be happy to help with reasearch on this , and I mean that.

You can't file a waiver until they hand you the denial at the interview. Some embassies allow you to file a waiver right then & there, and if you're pretty sure of the reasons you're going to be denied, you can hand it all over. We know what ours are going to be, so we'll be prepared to hand it over. Our attorney plans to prepare the waiver and an accompanying brief. ($$$$$$$$$$)

Dublin seems to be one of those embassies where you can file the day of your denial, but they are adjudicated in London. From everything I've read, Dublin can make a recommendation for yay or nay, but they still have to go to London. And there's a long wait in London right now, so... I'd better get comfy for another long, cold winter of slugging firewood around.

In order to get a waiver granted, I have to show EXTREME hardship. Not just "I don't want to." I'm gathering my evidence, and trying to remain unemotional about the hardship letter, but it's difficult. I want to basically plead for mercy! I do have some compelling reasons why I need to stay, so I feel pretty confident about the ultimate outcome, but you just never know.

Husband and I have maintained a solid relationship for years, and have weathered many stressors, including the death of his daughter in 2007. That reminds me of something -- after her death, we left from the funeral and came here so that he wouldn't have to grieve alone. He had just been here in February, and was returning in March. The Border guy actually said to him, "Why don't you spend some time in your own country." This, to a man who was numb with grief.... So I guess I'm a little worried about the government's capacity for compassion.

I don't know about ya'll but I really hate NVC so far. They haven't assigned me a freaking case number............................ That is the easiest part, come onnnnnnnnnnnnnn, I hate this immigration process, so so lengthy.

You should but I don't know if it will help. I mean they just read off whatever they see on the screen. But just speak to one for a change.

That's really sad. I just hope that he will be granted the visa soon. I don't know anything about the waiver process but I truly hope everything will work out for you.

i definely advice you to speak to an operator ,,, i thought you did that by now ,, my K3 is already in the system and i was given a case number i just did not want to continue with that i choce the CR1 yet,, the system still kept on saying " we don't have your case in this office "( by the way i cannot stand that voice ) i was just checking it periodicly it still says that ,,, press 1 and option 5 for the talk to live operator good luck !!

Jo as soon as yu get your case number and they email you your IID number you will be able to log into the NVC system and pay you first AOS invoice. this time next week I bet you will be rolling along!!!!! Hugs
