Just back from the interview and am glad to say I passed! :dance: Nice and simple, really...unlike the other two couples there who didn't know a thing about the process :blink: One couple even filed for the wrong visa-type! :wow: Seriously people! lol

I will say that I'm glad I changed my mind and decided to check "yes" to the have I ever been denied entry question, because they certainly look at it that way! In fact, they told me I was "red flagged" for a refused entry and that it would come up on my record every time I crossed the border. I was told that even with the K1 visa in hand, I would be questioned about the refused entry!

In the end, it didn't have any impact on the visa itself, as we all knew it wouldn't, but it did require explanation.

I just told them the truth and that was good enough for them. The nice officer who conducted my interview said "as long as I stick to the same story every time, I'd be fine"! lol It wasn't a story, it was the truth!

The first couple through also had a similar flag on their history, but they answered a little differently than I did. When asked why were you refused entry, they said "because the guard was an idiot." :bonk: I think that goes in to the "what not to say during your interview" category! lol

Anyway...for those in a similar spot in the future, a "withdraw of an application to enter" counts as a refused entry. Not that it will hurt your visa application, but it will be questioned.

Nope, it can't be removed :( She did say that once we're married and I've crossed a few times, the annotations will make it clear that it's old news...but it will never go away. I don't think they'll even question it once I'm at the green card stage. Until then, it just means a few extra questions to answer.

well I was refused entry and banned for a year and the only time they said anything about that (besides the interview of course) was at the Vancouver airport when I was using the visa for the first time.. the grouchy looking guy who processed me took my visa package typed some stuff into the computer and says, "so you were planning on moving here.." I got scared then, I thought he might not let me in but he never said anything else about that and took my fingerprints and picture and stamped my passport and I was on my way...

I have been up to Canada twice since I have moved here and I haven't been questioned about it at all...

"okay guys, here's the deal we may have inadvertently lied on our k-1 paperwork.

the very first time my fiancee visited me (this was like, over 8 years ago) he was sent back at the border because the ins felt he didn't bring enough paper money with him to be in new york for a week (eventhough he had his bank card with him and he was staying with me, therefore not needing a whole lot of money anyhow).

he went home, went to the bank, pulled more money out and came to visit a day later without further incident.

he's never been denied at the border again.

on our paperwork we put he was never denied entrance to the u.s. because, frankly, we pretty much forgot about it because it was nothing to us.

is this going to come back to bite us?

really. really. worried..."

i was told to make an appointment using "infopass" but i dont know which kind of appointment we need:

"We offer 4 kinds of appointments for a case that you have already filed. Please choose from the following -

Order from Immigration Court - If you were directed to us for processing based on an order from the Immigration Judge. You must bring all documents required in the post order instructions given to you by the court.

Case Processing Appointment - If you received a notice to go to your local office for further case processing.

EAD inquiry appointment - If your I-765 employment authorization application has been pending for more than 90 days.

Case Services follow-up appointment - If it has been over 45 days since you contacted NCSC and have not received a response to your inquiry. You must bring the Service Request ID Number related to your inquiry to the appointment. "

also, do i make this appointment in the u.s. or canada? kind of confused... :(

Glad to see that everything went well with the interview. Definitely best to be honest and explain the situation (for all those who might find themselves with a similar status).

Just to clarify, however, a VWP refusal is a relatively minor thing and from what I understand, has little or no effect on the visa process. It simply means that the individual who was trying to enter the US did not meet the criteria of the program, and is much different from a removal or deportation (considerably more severe). My wife (at that time my fiance) was denied entry via the VWP in March of 2007; the officer (nice guy really, who actually let my wife stay for several days in the US with me on a humanitarian basis notwithstanding the refusal) simply explained that she had not spent enough time out of the country before trying to reenter on the VWP, and hence did not qualify for that type of entry.

When you're filing out the forms for your interview, then put down that you were refused. If you sent the D-156 already, then just tell them at the interview if asked, that your fiance was turned away at the border as he didn't have sufficient ties to Canada (money) when visiting 8 years ago. I guess given the above OP, it appears it will be on their screen in Montreal. Just be honest when they ask you.

Infopass appointment? Gosh, you don't need that at all. Your application is now in NVC, or Montreal, and you're going to be getting an interview soon aren't you? An infopass appointment in NY isn't going to do you any good, and I don't know what you would say to them anyway? Just be prepared at your interview to explain that when your fiance was turned away at the border that you forgot, as it was 8 years ago, and you thought you'd just explain it at the interview as after he got more money he was admitted.

Interesting. There have been a number of members who said the interviewer kindly removed the flag from their file.

Like Carla says, an InfoPass appointment will do you no good. Just explain it to them at the interview.
