I have a friend who asked me about his having to report an illegal immigrant. He knows a man who is here illegally. The man's B-2, business visa? expired. He said the man has gone to an attorney about it, but he is not sure if he has to report it to USCIS or someone. Anyone know about this kind of situation.

Thanks for any information.

I think it depends on the state. I know in GA there is no law regaring requirement to report an illegal alien. But I can guarentee you that USCIS or ICE is WAY to busy to be dealing with 1 single illegal that is reported.

USCIS or ICE is WAY to busy to be dealing with 1 single illegal that is reported.
We don't know this for sure; ICE might jump at the chance to "nail" a specific referral.

If the now-out-of-status man has gone to see an attorney about his situation, I wouldn't get involved. Let the interminably slow process play out. Just one opinion.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

The answer is just plain no (in every state, as this is a federal matter). Especially if the "illegal" is trying to get straight. Even if the USCIS or ICE got the report, they are too overwhelmed to do anythng about it. Been there, done that, at someone's legitimate request because she was being denied use of the phone, didn't drive, and had no way to do it herself.

I asked my lawyer this, if i discuss my situation with people will they have to report my boyfriend (who is not legal). He said I should not discuss it with people because they can but immigration is busy so they may not do anything.

There is no law requiring a person to take action in regard to immigration issues. In fact, many States even prohibit peace officers to even ask for a person's immigration status.

Secondly, "illegal immigrant" is a term not used in official language. There are non-documented immigrants (people who entered without inspection) and people who are out of status (people who entered legally but failed to update their status), which are two different things.

Thirdly, the fact that someone speaks English with a certain accent means nothing. It's like assuming somebody who drives a Cadillac Escalade is wealthy, when he's in fact an idiot and, in most cases, a poor Schmack, living on credit by showing off instead of investing his money wisely.

Finally, even morally there's no consensus about whether or not one should report another person. Karma can be a ###### that's following you longer than you live . . .

i just have 1 quick questioon... so shall i say im sooo fob.... like Pamily instead of FAMILY, FIFOL instead of people. i drive a very old 1982 toyota corolla, and i use the cheapest detergent you can find... i go to walmart for everything....would you think of me as someone illegal??? mind you, there are people who speaks great english and even have the accent, drives a very nice PILOT and are here illegally...

there is a moral imperative to reduce crime. illegal immigration is a crime, and it's effects are a pox upon your children. they will be paying taxes for generations to cover the monies already spent by our government as a result of illegal immigration.

state and federal spending is done on behalf of those legally residing in the US, whether citizens or documented aliens. to make it simple for you, every time an illegal child is born in USA or an illegal child enters a US school or an illegal person is arrested and incarcerated money is taken out of your pocket and your children's pocket as surely as if the illegal put their hand in and took it themselves. how much? 10-15% of the entire states and federal budget, by best guess.

then there are the crimes commited by illegal aliens, ranging from drug trafficking to drunk driving to DUI homicide to pandering to rape to robbery to child molestation to murder. tell my buddie's parents the illegal who killed him while DUI should be here (skipped bail, so prolly still is). tell that to the parents of countless children that have been molested and killed by illegals (google it). tell that to thousands of people that are murdered each year by illegals (google it).

secondly, calling an illegal alien an "undocumented immigrant" is like calling a drug dealer an "undocumented pharmacist". they both exist outside the bounds of behaviour that is regarded as acceptable by our society. they are also both breaking the law. they both need to be rounded up and put behind bars.

thirdly, i agree tha accents mean little in the melting pot of today's America, but would remind that there is a statistical probability related to some accents. that being said, i kow an illegal romanian girl who jumped a K1 and pupped a kid as an anchor. she is reported and her case is being processed.

finally, most of us have a moral concensus related to reporting of crime. you are on the outside, as are many people on this board, which is not mainstream America. almost everyone on this board is involved with a foreigner. that makes us a distinct minority in America. and as for karma, you need to read a little more about it before corrupting the word to suit your own purpose. karma is increased by activities that lead toward order, not by being inactive in the face of disorder. the tao teaches the same principle, and was written 800 years before indian religions came to china.
