I am the Canadian who is going over to the US. We are happy but cannot get engaged yet due to divorce paperwork. I am doing a bit of advance research as I have no idea where to even start this process. I just want to be sure we can do this right so i can be allowed to go back and forth without hassle. (i have my last remaining parent in nursing care and have to come back and forth frequently)

I already have my Nexus pass however that does not give me permission to stay there any longer then 60/90 days without return. Without work for that period of time i cannot have my household here kept up. Sorta hard to pay rent when your not working. So I'm at a loss.

We have been told just get married and i will automatically be given my green card the day after (which i think is fairy tale stories) I have been told get married and i can file and i will get automatic green card status but it can take 8 months. In which time i CANT cross the border (which is not an option with a sick parent) We also have been told this entire process can take YEARS to complete.

My other concern is my 16 year old daughter. Will she be allowed in with me? I won't leave her behind with her father. If it takes years to complete will she then become too old to piggy back of mum sorta thing?

Lost lost lost..... any suggestions? I've looked at the boards with all the forms and that is just SO confusing!!

I'm willing to answer questions if its needed for a good answer....

The first thing to read carefully is this section:

Once you're divorced, you basically have two options K1 or CR1

In your case, I'd probably go with CR1, which basically means you first get married then apply.

Why? Because you'll straight be granted the greencard and will not require an Advanced Parole document to leave the US for travel back and forth.

The process lasts about 6 months, but there's no warranty of a specific timeline...

You're able to travel to the US during that time.

And yes you're able to bring your child with you if the father agrees.

:rofl: If only! It USED to be that way about 20-30 years ago. You got married and you moved. But unfortunately, given the way the world is now, you must either file for a K1 (fiance) or CR1 (married, conditional).

Given the fact you need to go back and forth across the border, ( I'm assuming your SO doesn't live that far away from you?) you should definitely check out the guide lines for CR-1 and read a lot of the threads in that forum. I really can't help you much in that, ( as I'm K-1), or about bringing children, but again, there should be guides and plenty of threads for you.

take the advise given and read he guides. plan to dedicate your heart and soul to this process. it does take alot of time. hopefuly not years plural but remember when you reach the consulate stage for Canada the wait time for an interview is around 4 months.

The fees are stated in the instructions for each form. I always read them carefully, then highlight every action item. I recommend the CR-1 visa in your case also. Lots of helpful information and friendly people in the Canada Forum as well. Welcome to VJ. :)

The guides section on this site is excellent. I wish I could confirm the fairy tale, but sadly it has become something of an urban legend :)

It's been a quick and relatively painless journey thanks to tireless research, dumb luck and this community :)

DONE with USCIS for a while :)
