Hi all. I tried searching the forum, but there is so much information, I'm hoping that someone can just answer my question. Basically, I had a baby not too long ago and my mother came down from Canada for a couple of months to help me out since I'm in my senior year of University. I recently sent in my N400 paperwork and it is being processed way faster than I thought it would be. Originally, the plan was that she would stay a couple of months, then go back home, and when my N400 was approved sometime next year (or so I thought), I would submit the I-130 for her to come here and live with us. Since the N400 will probably be done soon now, we are wondering if she shouldn't just stay and we file the AOS and I-130 while she is here (since she didn't intend to stay when she originally came and we can prove this).

Can we file for her employment authorization at the same time as the AOS and I-130? If it takes a year or so for the application to be approved and for her to be LPR, then she will go nuts if she can't work at least part time during that time.

Also how do I find out what the processing time is for I-130 for parent of a US citizen in the Montreal consulate? If we're talking a huge difference between waiting for the I-130 in Canada or having it done here, then the answer about what we should do is a no-brainer.

Any advice would be appreciated. Thanks y'all!

You can apply for her while she is in the US and yes, you can file for her EAD at the sametime.

Mom sponsoring for her son(my brother)

05/23/2012: Application approved after RFE response
06/29/2012: Received letter from NVC
